Triton DCA piling on pressure

hi all,
im having problems with triton credit services. i requested CCA's for two accounts but they have only supplied me with one. the account they havent produced a CCA for they are pressuring us to settle account £3500. i sent a financial statement, which i get phone calls and letters to say how can we sustain having a deficit. so i had to change it so we only have a deficit of 1.25,lowering my food shop and taking clothing allowance off, i havent been able to buy my 3 children any clothes for months anyway. im currently trying to pay my mortgage arrears of £2000 at £300 pm, hence lack of money. well triton wont accept £1 pm payment and ive received a letter today saying that they have no alternative but consider further action to obtain repayment and to request a debt recovery agent calls to agree a proposal. i feel im banging my head against a brick wall. thinking back to my CCA requests i think i may have put both requests in one envelope along with 2 postal orders. so now they want us to contact them again.... they all have such bad attitude chips on shoulders that its hard and unlikely to have a civil convo with them.

  • First of all, please dont worry too much. A doorstep collector enjoys the same powers as your paperboy, and less that the postie. Should someone knock tell them politely to go away, as they are trespassing. If they dont agree to your request tell them you will call the Police, that will almost certainly see them turn tail:rotfl:

    If they have failed to supply the CCA then the debt is unenforcable. Check if the postal orders have been cashed, and if they have then they owe you the CCA at the very least and in law now have an unenforcable debt without a court order first.

    Most importantly you should ensure that the essentials of life are covered first, that includes clothing (try walking about the supermarket in your birthday suit, you will be led away) Triton are trying to extract as much as they can, resist, a court will more likely award a much smaller amout than they want

    Check if the postal orders have been cashed, and if they have then they owe you the CCA at the very least and in law now have an unenforcable debt without a court order first.

    ive just realised that i sent a £2 postal order, but requested that i want CCA for the 2 accounts they hold. i guess ive done this wrong???? should i send another request?

    yes send another request . All these DCA employ scare tactics , if they are unsecured loans or c/c , do not worry . If you can not afford it do not pay them a penny .

    Make sure you send by recorded delivery. the post office site can then tell you if it's been delivered or not. It's up to them if they cash it or not
    June 2005 = 48K of Debt:cry:
    Sept 2006 Started dmp = 56k of Debt (inc fees and charges) DFD April 2030:eek:
    May 2008 = <5k of Debt (CCA route -48K, paid off 3K) DFD April 2010
    Nov 2008 Lloyds found CCA for 14K loan:mad: New DFD Jan 2016

    Happy so far tomorrows another day:confused:

    Triton are an absolute nightmare. Stick to your guns and they go away in the end and give up. They have the rudest staff ever. Do not give in to them. Send them the least you can. They even tried to refuse when we phoned up to offer payment by card and got the hump when I explained that they could not refuse if we were trying to pay no matter how little it was. It was a long road but they do give up in the end. Good luck

    hi all,
    since i last posted, ive contacted triton with regards to my CCA request. operator said that a letter should have been sent on 8th feb, saying that the original terms and conditions couldnt be found. i havent received anything. so got put on hold as she went to see what happens... and got cut off. rang back and was told we are abusive... i wasnt abusive today:o . just the operator was umming sarcastically, and when i pulled her on it she said she's trying to take in what im saying.. so i suggested was she having trouble understanding!!
    anyway, couldnt get the original operator to see whats going to happen now, but another operator said that they will now send the CCA. i requested it on 22nd january. what happens now if they do supply it. they said they will just take me to court anyway now, but as far as i understand they need the CCA to do so.... also why when you ask about a CCA do they play dumb and dont seem to know what it is?? i have felt ive rattled their cage today:rotfl:

    they can take you to court and produce it then but they would be silly to if they don't have the CCA as the debt would be unenforceable.

    Golden Rule. Dont communicate via telephone, ever. Its your word against theirs.Always exchange in writing so there is a record.

    Wait a few days and see what they send you, in anything. If they do produce a CCA then please come back here, just be sure that it is a CCA and not some other irrelevant bumf. The CCA will have YOUR signature on it. Folks here will then be able to advise the best course of action. I have a feeling they dont have the required documentation, and if that is the case you can tell them where to go! There are template letters around the boards and I will endevour to post the relevant ones to fit the circumstances when you know them.

    And remember be strong, they will try and brow beat you out of as much as they can even (especially) if the law is against them.
