Question on bankcruptcy

My wife and I owen £90k between us, approx £45k is purely in her name. She does not work, is it possible for her to declare herself bankrupt? and how does this affect myself?....would i be liable for her debts as her husband and would the courts allow her to go bankrupt?

She would be able to declare herself BR, any joint debts though would then fall to you

You would only become liable for any joint debts (ones you both signed for).
As to if the Judge would let her go bankrupt that depends upon the circumstances, i.e, is there equity involved (i.e could you sell peoperty and pay all your debts off), are you keeping up to date with the monthly payments, are the reasons for wanting to go bankrupt temp etcAll comments and advice given is my own opinion and does not represent the views or advice of any debt advice organisation.

We voluntarily gave up our house so have no assets, I cannot go bankrupt as it may affect my job in the future. I am funding paying her debts on a monthly basis via DMP via CCCS0

If you are already dealing with CCCS then I recommend you phone them and talk to them about your situation. You do need professional advice on this. If ultimatly you do decide that your DW should go bankrupt then you need to do this or the judge could purspone your petition until you do.
