I'm going to be facing a divorce petition if I don't go to bed soon.:eek: :eek:
For a debt of £1,000 there is no way on God's earth that a creditor is going to petiton for your bankruptcy, or put a charging order on your house. It's just not going to happen, but don't ignore the post, and do take professional advice.

Thankyou, i'm going to ring them tomorrow rather than email or post as they seem to easily fob me off this way and i think i've got some right hitler looking after my account as i don't get so much as a hello or goodbye on the email just the actual text.
I will see how far i get tomorrow (with my extra knowledge). Thank you ever so much, mind at ease a bit now.

Hi all,
Just thought i'd let you know i have spoken with the company involved and yet again recieved both a rude and unhelpful one line email telling me they would only accept £200 per month which i have already told them whilst i'd love to do this and get it out of th eway i physically don't have the money to pay it without sacrificing my mortgage payments and i'm not willing to do that as it will leave my kids out on the street.
They have said that even though it will cost them above the amount i owe to apply for the petition they are still going to do it.
What do i do now? Is there any way i can go straight to the court and sort this out with them rather than the company as i'm sick of dealing with them now and they just will not listen at all. I have told them that despite everything else even if they did make me bankrupt and the court said i had to sell my house i wouldn't have any equity in it anyway but its just doing no good at all as they won't listen.
Out of interest, if it did come to the worst and i did have to go bankrupt for the sake of £1000 would it wipe out all of my debts and just leave my mortgage. I have a secured debt of £20,000 against my property which costs me £320 per month. Would I have to sell my house in that case even though if i did there wouldn't be any equity anyway?
Hope someone can shed some light as am even more confused as to what to do today now...

You really must phone the National Debt help line. its free to call, and the advise is free and confidential and they are on your side. Please please call them. They will advise you of your options of each of your debts, and what tactics you can use etc
If you have offered 200.00 and the company has rejected it you need to carry on writing to them offering the 200, and MAKE SURE YOU PAY IT each month, because if you have made that offer and you dont keep to it then if it does go to court this may be brought up in their defence.

Me again.
Still no joy with the horrible company that i'm dealing with however i spoke to the court who issued the ccj and they have sent me a form to complete with my income and expenditure etc.
I'm confused as their form says they will forward it to the claimant to see if they will accept but i know that they won't as i've already tried to offer them a reduced payment. Am i just paying the court £35 for them to tell me the same thing or can they intervene and look at my income and ependiture and override the claimant?
