Do I need a solicitor to claim after an accident at work?

The insurer has made a big thing recently about workers not signing onto the various electric trucks when an accident happens. If no claim is put in the insurers don't get to hear of what happened. Thats why I'm looking to get at the insurers.

The last time the HSE people came to investigate an accident the union reps were too busy to show them around, so they just left. Guess what, the person that injured me is one of two union reps on nights. I hold out no hope of getting anywhere with the HSE or union.

Are you sure they were from the HSE? In my experience, they do not leave without having their questions/queries answered, and by appearing to be too busy would prompt a return visit.
I agree with the other posters, I think you may be going about this the wrong way by attempting to claim from the insurers. If the accident prevented you from undertaking your normal range of duties for more than 3 days, it is reportable to the HSE and this may be an avenue for you to explore. Or by meeting with your Union/H&S Rep or Line Manager and expressing your concerns.

I got nowhere with the internal complaints system and did write to the insurers. Over a month and no reply. Apparently they won't reply to individuals so I'm not holding my breath.
I've since had a visit from the HR heavies to tell me I'm stirring up trouble for no purpose. They also said I should see a solicitor if I have an issue with being injured at work. So...
I spoke to a solicitor. They got all excited and suggested I ask for £1200, but I would get between £300 - £600.
I tried to tell her I was not really after the money but the solicitor just couldn't get the point (like some people on this board).
Result is that I am not taking any complaint forward anymore. It is just not worth the hassle.
