A few questions???

Hi all, i've been reading this site for a while now and find it amazingly informative and reassuring. I was wondering if anyone could find time to help me with a few questions.

1) Can a career training course (home learning diploma) around £80 per month be allowed by OR?

2) I'm probably going to have to move back to my parents for a year until discharge, so will go bankrupt there. Will I have to get a written tenancy agreement to present to the OR and have they got licence to pry into my parents accounts, affairs etc??

3) My current landlord has had financial difificulties themselves and has actually offered my full deposit back £450 in cash the day I leave next week.
Will the OR think this is suspect and will they want to see my tenancy agreement anyway which does mention the deposit?
I would really like to keep this as this will be my deposit to move back out again.

4) If possible I would like to avoid receiving an ipa (as we all would), but due to my parents being retired and some strange pension scheme they are on they cannot be seen to be receiving i think more than £350 per month from me. Which was what we agreed for rent, but i also wanted to contribute towards bills, phone, water etc. Is there anything I can do so that the OR can see that i'm paying these as they would be on my i&e but not to affect my parents pension by paying in total over the £350? They are away for 6 months of the year so its only fair that I pay half of the bills.

5) I want to do everything I can to help the OR and am happy to provide whatevers required of course. But it got me thinking, is there a set procedure as to how they work, is it a case of once your i&e is agreed to they check that all of those exact payments go out of your account every month and then you get a tick? Or is it a case of once agreed your left alone until you contact them with a change of income etc?

6) Do you need certificates or evidence for everything on your expenditure for OR, such as prescriptions, contact lenses, car insurance etc, bills although under my parents name, just so I know to get all ready???

Sorry to ask/bore you all with all these questions but i'm so stressed and depressed about where my life is currently. I can't remember the last time I had more then a few hours sleep or thought about anything else but bankruptcy.

You guys have been so helpful with others, i hope you can help me too.

    Thank you Sarah, that is really kind of you. I don't know how i got to this situation but now I'm here i just want to make the best of a bad situation.

    Hubby and i both went BR 27th Feb,not had OR interview yet:eek:
    We have lost our house......... Now in rented. It's lovely but i found it all very difficult.But i can say the hardest thing was admitting the problem to myself and family. It really will get easier the support i've had on here is FAB.
    Keep posting/reading it really helped me and i'm sure it will you.

    i'm very sorry to hear about your hardships and couldn't even begin to think what it would be like to lose a house. I hope that your interview goes well and that you can really start planning for a bright future.

They are not going BR you are. The OR cannot look at anybodies bank accounts willy nilly only those he has permission to ie: the BR. You could get a rent book from WHSmith if you want, that will surfice. The OR may write to your parents to confirm the amount but as long as that is a fair amount for a room in a house in your area then you should be ok.

You are leagally obliged to let the OR know of any changes in income up or down within 21 days of the change.

    Don't panic to much you are to be congratulated on taking steps, albeit difficult ones, to get everything back under control.

    Have you taken professional advice from one of the debt charities? You must do this or the judge can refuse your petition untill you do.

    I am not an expert, but I would say that you could be classed as a lodger in your parents home. You can gain income from a lodger up to £350 pm tax free so this should not affect them (personally this seems quite a lot if your parents don't have a mortgage and you are going to contribute to bills.) I'm in a similar position of living at parents place whilst applying for BR. The bad thing about it is that it will be published in their local paper, giving their address etc. I am going to appeal to the judge not to do this but guess that this is unlikely.

    Its a shame that trying to get further qualifications to try and better yourself wouldn't be allowed, surely that would be an indication to the OR that you are taking your future seriously and don't want to be in this situatuion again?!

    Very good idea with the rent book and extremely reassuring to know that my parents affairs won't be taken into account. I feel bad enough about moving back and just want to make it as smooth as possible for them.

    I'd heard the tax free £350 for a lodger but wasn't sure if this would apply to immediate family? if so then that would work out perfecty. The reason its a little higher is because unfortunately they still do have a mortgage to pay themselves. I don't mind if its helping them aswell.

    I've spoken to the cccs who advised br but wanted to speak to the cab in person but am finding it impossible to get through to them.

    No problem. I should think that you would be able to pay a portion of your parents bills as well as you are living there so obviously they're expenditure will go up. I don't think it will affect your parents pension situation. But it may be a good idea to have a word with National Debtline or CCCS about it.
