cabot financial

afternoon all.

this morning i got a letter out of the blue from a company called Cabot financial, informing me they have bought my debt from barclaycard,their letter included a letter from barclays, which i am treating with suspicion because they did not write to me themselves. The thing is i have an agreement with barclaycard to repay my creditcard debt back at £1 month, i have a letter dated 27th september from barclays because mercers tried to take action against me without being authorised to do so by barclays, letter does mention my payment programme with them and they were dismayed by mercers actions. Now i get a letter from Cabot wanting payment. I am lost in what to do about this problem,should i email the lady whos name appears on my letter from barclays on 27th september for clarification. I am going to get help from a community legal project in respect of all my debts,but would appreciate any advice on course of action for this immediate problem. any help would be appreciated.     thanks for the reply. I got a phone call from cabot this morning,with the usual question confirm my details, i refused to give them my details and got into an argument because the bloke from cabot was not listening to what i said, i refused to give details over phone under the data protection act. I was told that if i did not speak to him then they would keep ringing me until i did, i took this to mean they would harrass me until i either paid up or spoke with them. I informed the caller that i do not want to speak with him and cabot are not to ring me again, i told him that under the administration of justice act if they keep ringing after i said not to i would consider it harrassment under said act and i would have no problems reporting them to trading standards. no amount of taking got anywhere so i said get lost and hung up,
    that was the politest i have been to idiots like that for some time. I have emailed a lady at barclycard who i have dealt with before asking for written confirmation that my debt has been passed to cabot even though i have a payment plan inplace and have written proof of the agreement on barclycard headed note paper and signed by the lady who i have spoken to in the past. i will have to wait and see what happens next.:confused:

    A CCA (Consumer Credit Agreement) is a copy of the original legal agreement that you should have signed in order to get that card.

    It won't be on Barclay's headed notepaper or signed by the person you mentioned. So it seems as if you haven't got it.

    If you make a formal request for the legal CCA, then they must supply it within 12 days. If they don't then the debt is unenforceable until they do.

    And it should be a "true copy" of the agreement. Not a letter, or an application form that doesn't contain the information that a proper agreement should under the Consumer Credit Act.
