Car on HP again sorry!

hi all, the OR said he had no interest in my car at all as i owed more than it was worth. so he told he would write to my HP company, then they should get in touc with regard to sorting it out. this was mid feb and ive still not heard anything, they know im b/r as i rang them and told them, again they said they would in touch with me about getting the car back.

do you think i should ring them or wait till they get in touch, i wont get in trouble for driving it will i?

    Hi,

    Has the agreement been checked to see if it is actually HP ? Many agreements look like HP, with car registration details etc ( Black horse are notorious for this ).

    If it is HP then they will no doubt contact you in time. No you will not get in to trouble for driving it.

    When I was in this position, the repo men turned up out of the blue one day to take it. Well, I had 2 cars involved since my other half's was in my name. The repo guys for that company rang and arranged a day and time for collection, all very civilised. My car went without warning. But they were very nice to be honest. I was just back from a camping trip and all my stuff was still in the car - the offered to help me unload, and told me not to worry about the rubbish in the car as they were literally just taking it to the auction room. They called my finance company !!!!!! and wished me well for the future LOL!

    This was all about 6 weeks post BR and the worst part was I had had to insure it because I couldn't risk having it sat on the road and something happen to it while I waited for it to go. I lost a load of money when I cancelled the damn policy!

    I think every situation / OR is different so dont take this as gospel. However we bought a brand new car on HP 3 months before going BR and it was the only payment we kept up to date with, on professional advice. The OR said he had no interest as it was not our asset, however he did say the finance company would probably terminate the agreement and sieze the car back. We wrote to the finance company straight away (as did the OR). After a few phone calls and letters confirming our status we recieved a letter back from the finance company saying they were happy to continue with the agreement and as far as they were concerned the matter is closed. Twelve months on, no problems.
    Today was Today. Tomorrow is Tomorrow.

    We were in this position a short while ago.
    We had car finance with Welcome Finance, we have had the car since 2004, we stopped paying in Feb 07, but according to hubbys credit file we only stopped paying in Dec 07, oh well. Anyways hubby went bankrupt in Aug 07 we called Welcome and told them, they said they would arrange for the car to be collected. Well we heard NOTHING at all no default notice or anything. So after phone calls every week to Welcome asking when they would collect the car, i got fed up so i rang to OR they were not that interested and told me to take it up with Welcome, but they did say Welcome never replied to any of there letters. So i again rang Welcome and they said they would pick the car up within 7 days. Again this did not happen, i rang them yet again and i was told that because we have paid a certain amount they cannot just take the car they need to go through the court. So i waited again, still nothing the next time i rang them they asked for a copy of the bankruptcy which was sent again to them by the OR at my request. Well they then said they do not want the car back and the debt is clear due to the bankruptcy. Talk about shocked, i didnt believe them so i rang them 4 times to check and each time was told the same thing. As far as i know it was a HP agreement we had with them not a loan, they said it was HP so no idea why we got to keep the car. So 4 mths on we still have the car and have heard nothing from them at all.
