Claiming on Mortgage insurance for wifes ill health

Over the last 16 years I have been with the Lloyd's TSB as a mortgage provider. We now have 4 sections to our £100,000 mortgage, one is an Endowment from the original purchase and a further 3 repayment sections from a move 10 years ago and 2 cash releases, 6 and 2 years ago.
My wife has a fairly rare genetic condition (Ehlers Danlos Syndrome) which has meant for the last 10 years she has been unable to work. We only managed to get a full diagnosis from an expert about 5 years ago. She is claiming higher rate mobility and Disability Living Allowance because the condition is one of the governments "allowed" disability conditions.
When we took out the last cash release we disclosed the condition to Lloyd's TSB and the result was a large increase in the premium they required for her to be on the life insurance for this final amount. We declined to have her added so I am the only life assured against the final sum.
I thought at that time I would approach their life insurance department and find out if her condition would allow some form of payout on the earlier amounts. They said it was not a condition that was on their list but that I could appeal. At that point I decided not to proceed further.
Question. Do I have much chance of sucess if I appeal and has any body else gone through this process and can offer wise words.
Sorry for the length of the post.
Many Thanks
TT

With pure life cover, the policy should pay out on death.
Looking at in from a general point of view - whether it be the Ehlers Danlos Syndrome or anything else, if at the time of taking the cover out, you were not advised or aware of this condition then your wife should be covered.
The proof would clearly come from your wife's medical records. If there was a question on the original medical disclosure form that would ask whether you were receiving treatment for anything and you have not disclosed this then it may not pay out.
I would probably put a letter to the life company asking the question and look to get a response for peace of mind. If they come back and say no and why, you will at least know. Just ringing and asking doesn't put any commitment on them and therefore, I would suggest a letter.
Hope that helps you make a little sense of the matter?I am a Mortgage AdviserYou should note that this site doesn't check my status as a Mortgage Adviser, so you need to take my word for it.
