Cheque stopped by payee

Hi

A bad morning! I supplied goods to somebody after receiving a cheque (trading as a Ltd company) which they have now stopped at their bank. OK, a lesson that may have cost me £80 and I will be more careful from now on.

What are my options for a/ getting the money or b/ causing them as much trouble as possible.

Any useful suggestions and particularly devious one's appreciated.

    Your options are really requesting the money urgently either via a letter from yourself or a solicitor. Of course a letter from a solicitor will cost.
    If they still fail to pay then you can take them to court but your costs could really could outway the amount you want to get back and the time you'll need to invest. And of course ultimately the company may fold and leave you out of pocket.

    When I sold on ebay in the early days I had a few "bounced" cheques. They just got posted back to me stamped "represent". When I asked my bank, HSBC, if the cheques had been stopped or bounce because of lack of funds they would not tell me. Just said I have to ask the sender. I never found out if they had been stopped or bounced.

    A cashier did tell me that if the cheque had been stopped it would have cost the sender money to stop it, and if I represented the check the sender would get charged again.

    So I did it and the cheque came back to me again. When I tried it a third time the bank wouldn't let me.

    Don't know if it cost the sender any money, but I checked all the big banks and to stop a cheque cost around 7-8 quid at the time. The cheque was for £10 and if the sender did stop it I hope they got charged twice.

    Sounds as though the cheque may have been stopped by the drawer, not payee. They probably wouldn't be charged if they claimed the cheque had been lost - but the bank might be interested given that it has apparently been paid in by the payee.

  • Some good points there, thanks. I gave them the chance to sort it out and they gave me a story about lost cheque book etc............we will see! If it isn't paid I will put it back through, I heard it costs about £15 to stop a cheque now, maybe I will write to their bank, pass their email on to spammers!

    The cheque will include this persons name, bank name, account number and sort code. If you do not reach a suitable conclusion to this I am sure there are many Nigerian scam artists who would be thrilled to get their hands on this information*
