For those who have had a CCJ, could I pick your brains please?

Hi everyone. Sorry for being a pain in the backside, I did ask a question regarding CCJs the other day.
Basically, for those of you who have had CCJs could you please tell me:
1. On the form asking for your income, etc you have to state your wage. My OH can work overtime some months, but this is not always available. There can be several months when no extra hours are available or two or three months when the overtime is there. So, it is not regular and the hours are never the same.
Do we put his basic take home pay down? And do we tell the Court about the overtime, despite the fact this is not guaranteed?
2. On the form you have to state if you have a savings account and if so, how much is in it.
We are starting to save some money each month for a contingency fund i.e., in case the boiler blows up, or the roof blows off, etc.
Will the Court make us use this money to pay our debts, or question the fact that we even have the savings?
Thank you so very much for your help. Me and OH have been worrying about this for days now and have searched the internet high and low and found nothing to help us.

1. I would put your basic down and not mention the overtime as its not guaranteed or often. If you get extras then you can pay some off your debts.
2. Cant help with this as I have always made sure I pay things off before saving.0 -
Thanks Cleosmum.
The savings are not actual savings, just an emergency fund we are trying to build up as we will have no other cash over the next 5 years for unforeseen circumstances.*Official DMP Mutual Support Club Member No 147**Official DFW Nerd Club Member No 923*I have no idea what I'm talking about!0 -
Would you not be covered under buildings/contents insurance if the boiler blew up or the roof blew off?
I dont have an emergency fund, maybe misguided, but I just cant afford to put money toward one

I think the roof would be covered, but not the boiler etc. We have only managed to save a bit each month by cutting back to the bone on practically everything.
Having lived a life of "stick everything on a credit card" we now have to fund any emergencies ourselves. We have already had to do some work on the car but luckily had sold some things on Ebay which paid for this.
I tell you, we really appreciate money now (definitely the lack of it!)
I'm just worried that we will scrape together our emergency fund and the Court will want to take it off us or at least question it.
I seem to be worried about something on a daily basis. I sort one thing out and something else pops up!

1. Put down only what you are 100% confident you will receive.
2. Say nothing. Saving for a rainy day is prudent, not a crime. However, if it's a large sum (£1000s) don't try to hide it! Pay a debt off.
Remember, you return the CCJ forms to the creditor that has taken you to court, so the CCJ will be administered by them with the backing of the court. Only offer what you can afford.
Hope this helps.'While wealth can be a magnet. Poverty is a form of repellent.'Nelson Mandela0 -
Thanks so much Blackcat, your time is appreciated.
Well, it won't be in the thousands (sadly) and if it were, we would pay one of the debts off. Basically, it's what we can save each month after everything has been paid (including the DMP) and by eating a lot of beans on toast! ;0)
Thanks again :0)*Official DMP Mutual Support Club Member No 147**Official DFW Nerd Club Member No 923*I have no idea what I'm talking about!0 -
Just to add to what others have said - when the court works out how much you are to pay your savings will be divided by 12 and that figure added to your income. Thats the reason you are asked if you have savings. x xPay Debt by Xmas 16 - 0/12000

If you are that worried close the savings account and hang onto the cash till after your hearing. It is only an emergency fund after all. In your budget planner you would have made allowances for money you would be putting aside for car repairs, MOT costs, car insurance, house insurance and repairs etc. So it would be expected that you would already have money set aside for this. I don't think they check anyway.0
