  • hi, new to this and just got 2 letters from AKTIV KAPITAL demanding money
    for a debt 11yrs ago and this is the fisrt time ive had any contact regarding this,didnt no who this company was until i got the demand and also viewed comments/replies on this forum which is very helpful,

    Surely a debt collecting agency can't just sell your details to another company for advertising purposes? I thought that you had to be given the option to opt IN not opt OUT by post.

    Yes it is legal. Data Protection legislation allows for opt outs from mail and telephone marketing by any reasonable means including you having to write to the company. E mail marketing is at present the only form of marketing for which you have to opt in.

    I had a letter from Aktiv Kapital about 6 months ago and replied with the usual "I do not acknowledge this debt..." etc and haven't heard a thing since.
    [strike]-£20,000[/strike] 0!

    Don't know how they get hold of these debts, but they are fishing. The chances are that not many people will be aware of the 'Statute Barred' legislation and they will probably 'catch' up to 50% of those who they write to. Disgusting way to do business.
    I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
    If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.
