    Working out how much of your income the OR will consider to be a "surplus" is a bit of a "black art" to say the least.

    However, it is normally the case that they will be more generous with the living expenses that they allow than the supervisor/creditor's in an IVA are.

    But you would be allowed your rent and priority bills, even if they increase. An IPA is always revisable if your circumstances change.

    Highly unlikely that you would get any money back as well. I have never heard of it happening, and believe me if it was possible I almost certainly would have.

    hey guys....
    just thought i wud update.... when i got home from work yest i called cccs (the correct one off google i mite add)!, they cudnt offer much advice as i already had a iva runing and it would breach laws or something.... so i called the insolvency helpline, a very kind lady told me that they were a bogus company and 'business daily' were trying to get hold of them to discuss this fact - to no avail... she told me i should speak to my own ip b4 i make any more rash decisions.... so i bit the bullet and called my ip at freeman jones, i told him everything and he was very thankful for my call, the outcome is that i have reinstated my direct debit to them and that i am going to send all my updated details and he will review... he couldnt promise that he can defo get my payments reduced but he was certainly going to look into,. once he has come back, i will then make my decision, i am not that fased over the fact that loads forms to fill in for BR or that i will have to speak at the court etc, its just the stigma i suppose... but i cant get 'any credit' at the mo with my iva so it will just be the same with my BR? - i will just be better off each month... (do i need to tell my employer if i decide to go BR - i dont handle cash or anything, just basic admin at BA).....

    oh, and my IP actually called this bogus company and told them to stop ringing and harrassing me.... nice guy

    Seems to depend on who you speak to with CCCS. I've heard of them being very helpful with people in your circumstances, but I've also heard of the "we can't tread on the IVA providers toes" response as well.

    Not surprising that your IP had heard of them. These companies seem to be steadily working through all the people with IVAs.

    There are even similar "companies" that contact people who are newly bankrupt, claiming to be able to "undo the bankruptcy" and "protect your property". Just another way to attempt to exploit people that they know might be feeling "vulnerable".:mad:

    But anyway, glad to see that you are trying to get the situation dealt with, and are getting some advice that seems to be more trustworthy. :)

    Most people don't have to tell their employer about bankruptcy. I can't see why you should with your job, unless there is something in your contract. And I can't imagine there would be.

    just applied for my bankruptcy pack/paperwork/bible!
    spoke to a lovely lady at cardiff c.c who gave me a brief overview of what will happen,, and seeing as i am on tax cred etc i mite get the actual court fee waived..... after speaking to my ip (freeman jones), i have been thinking about it all weekend - and i know they are not going to reduce my payments as i am paying the lowest amount possible now, so ive taken the plunge, and going for it... already, my headache that i seem to have acquired over the last week has vanished....... thanks for advice and keep you posted...
