Mortgage Mistake?

I've had my mortgage with Abbey National for the last four years of a five year fixed deal. Recently i checked the paperwork and found that the address on the mortgage did not relate to my address. I live on an Avenue and the paperwork relates to Drive where another house already exists. I'm keeping up the payments on the mortgage so there's no problem there. I live in Scotland so was wondering how i would stand if i contested the mortgage as it doesn't relate to the house where i live? I need any advice to be 100% lawful as the job that i'm in.
I'd be grateful for any advice, It would be nice to get one over on the big fat cat banks?

    LOL your absolutely bonkers! contesting an entire mortgage over a mistake with the address? And added to that, what you are doing is immoral, a decent honest person wouldnt think that one up let alone contemplate doing it. Admitting it is even worse.

    For gods sake what is this country coming to?!

    You want to rip off the whole value of a mortgage, that you happily signed up to, because of a mistake on the address???

    Your solicitor will have registered a Standard Security on your property on your property for the bank. The fact that the offer has a typo with relation to your address is effectively meaningless unless your solicitor has also made a mess of it.

    Even then under Scottish law I don't think there is any scope for you to cash in as I think it would fall under "unjust enrichment" and the bank would be able to sue you for what is owed.

    Why don't you sue them for the distress it's caused instead? You might have more luck.

    This forum reminds me just how many freeloaders and chancers we have in the UK :confused:

    Not to mention their interest is probably correctly noted on the title deeds.
    Also you may find your in for a whole lot more if the house on Drive is mortgaged for more than your property.
