Council Tax Class C Exemption Question

Hope someone can help. We have bought shared ownership property from a company called Notting Hill Home Ownership. The properties were finally completed for moving in September 07 and we exchanged October 07. However we did not move in until December 17th, 7 weeks later as we are first time buyers and had to furnish etc etc.
We send all receipts to council but they have responded saying we cannot have Class C exemption as the previous owners applied for it in March 07 and it expired Sept 07. This is a brand new property (flat) which was not finished until Sept 07 so why on earth did Notting Hill claim Class C Exemption which now means we are liable for 2 months of council tax when we were not living there and flat was empty
Can anyone help on this matter - if property was not even built or finished why was it using Class C exemption ? i think they have f*cked up as usual as we have been far from impressed with them and if this is the case I am wondering if i can force Notting hill to pay these 2 months as they used the wrong class of exemption when flat was still being built ?

If you purchase an empty property that is already in receipt of this exemption then you will only be entitled to the remainder of that six-month period.
If after the six months' exemption the property remains empty and unfurnished there could be a further discount until the property becomes occupied or furnished. Lookup your councils Council Tax discounts - unoccupied properties.0 -
