can someone else handle another person's affairs?

hi guys,

Another question about my friend - my friend is suffering from stress she can't think clearly and wont answer the OR phone calls coz she finds them too stressful, as the OR is not very nice with her as she is not co operating. Anyway, I have spoken to her family, and her sister is willing to deal with her financial affairs, does anyone know if her sister can take over and deal with her financial affairs, or is this not allowed? At the moment the OR is threatening her with a public examination and she is in the state of "i can't deal with this, let them do what they want" She knows how serious it is, but cant face anything.
does anyone know how she can give authority to her sister to deal with her affairs? is this possible?

  • Her financial afairs yes, just a letter of authoraty or a power of atourny would do for this, however i dont think this would extend to doing an OR interview for her im afaid, i dont know for sure but i cant see how the OR would be able to except that

What you need to do right now is if she is willing to let you/the family to help is for one of you to put te OR n the picture which hopefully will buy a bit of time, then you need to get her to see her doctor to back up your claim she is incapable of dealing with the matter at the moment, that should at least get everything put on hold for a while i hope

hi thx for your reply, She has had her OR interview face to face, but it's just the phone calls after the interview that she is not responding to, as she finds it so stressful. How does she go about giving a power of attorney or letter of authority, i mean does she have to go through a proper solicitor?

    Any advice would be greatful
  • In that case if its just info they may accept it from a family member, or maybe you cn get the OR to put the questions in writing??

You can (or could as there where some changes in october of last year) get 'packs' from tescos, whsmiths etc that you just fill in and i assume get someone independant rom the family to witness, I know they said you didnt need a solicitor and all the instructions ar in the pack

As you will see these are only relevent if the person is mentally incapable. Your friend is not unless she has dementia or a degenerative condition.

Sorry...i stand corrected as above. However, i suspect this would only allow her financial paperwork etc to be handled and would not allow her to not attend interviews/hearings in person herself.
