    The banks have paid up until now in case the courts set a precedent, and because the amounts that have been paid out voluntarily are so insignificant in the bigger picture of things!

    Whilst I have sympathy for those that have financial problems, anyone that gets themself into such a mess as to incur large amounts of bank charges is certainly not smart!

    What the @@@@ are you talking about. Find me a lender that has re paid a products fee in or out of court???

    The OP who started this thread was only enquirying about product/arrangement fees. He was then ridiculed for asking a straight forward question which required a straightforward answer. I simply defended the guy and this lead to this long thread.

    After many post we slightly derailed to the whole legality of the other charges including bank account charges.

    My arguement has always been through out this thread the need to close such loopholes and to have some clearity on what charges should or should not be applied across the whole banking industry.

    Funnily enough I do agree with most the arguement raised here about the charges found in T's & C's and one should not come back years later to try and claim for something that they initially signed for.

    Having said that, at this present time, it's not all black and white so people will challenge the legallity of most of these charges and Banks will crave in at times to avoid setting any precedents.

    A better system has to be in place to avoid such ambiguity

    I throw the towel in - it's been a tough 12 round of boxing match and I am knackered to carry on this debate. When you check my previous replies, you will find that whilst I sympathise with people who claimed or try to claim against these charges. I blame the current system and hopefully at least one case will soon be decided and we will find out the verdict in due course

    There will always be someone out there to champion the cause of the consumer whether we like it or not. Because you are either too moral or simply don't believe in reclaiming these charges doesn't mean that Mr Average Joe Public will not try out his luck.
