    If you are retiring under the local authority pension scheme there are strict rules about what your employer can and can't do. If you are on a contract that gives you six months notice then I am sure that they will have to give you this notice, on full pay, before your retirement kicks in.

    Nothing you say to your employer will alter your entitlement - it's all laid down under the scheme.


    Hi thanks Merlin. Yes I understand this to be the case with local authorities, but I work(ed) in the private sector and am unsure if similar rules apply as by the time I do retire as these things take forever at our place I will be on zilch pay.

    Also I understand what you say about "nothing you say will alter your entitlement", but the dictatorous and somewhat devious head of finance who is also a trustee to the pension scheme and he has written into the company handbook that the maximum payable in lieu of notice (even if I was entitled to any) is 3 months. My contract clearly states 6 months as this was probably done to protect the company should I leave. This is sighned by myself and the ex managing director of my section of the parent company. This dates after the handbook was produced.
    I am expecting an argument over this so do not want to cloud the issue of my early retirement with this.:confused:

  • O.k. I had inferred from your earlier post that it was a local authority pension issue as you said 'it's another local council employer'.

    Private companies are a different matter, although a friend of mine worked for a private company who had taken over work previously done by the local authority and she was still entitled to retire under the local authority pension scheme.
