    Yes it may offer her an element of discretion from the OR. However, it doesnt excuse her from anything that has led her up to the current situation as the note is only valid FROM the date on it - it cannot be backdated.

    The power of attourney will allow her sister to handle virtually all communication - verbal or written. It will also allow her to sign on the person's behalf etc.

    funguy your missing the point no one is sayng it should excuse anyone its just that the OP,s friend is unable to deal with it now and if there is a true medical reason then the OR is obliged to give her some leeway as she is not just being awkward and not co-operating, she is ill

    Once better they can conclude the investigation

    Thank you blind-as-a-bat that was really sweet, and i dont think my friend wants her "stress" backdated, she just wants to get out of all this hassle and thx everyone else also for the replies.

    Does this power of attorney cost alot? i mean what sort of fees are we looking at?

    I agree with you blind-as-a-bat but "stress" is not a true medical condition - its defination is inability to cope due to emotional tension. There are so many people that complain about stress that i suspect it doesnt count for much anymore.
    Is she ill or is she wanting to ignore her problems in the hope they will go away? (im playing devils advocate here)

    My advice would be to go and get the power of attorney in place and let the sister deal with the immediate issues and then when things aare on a better path, allow the person to continue on with her own affairs.

    She should also see a doctor to make sure she is not genuinely depressed as that is a medically treatable condition.

    Dont forget that documenting issues of stress etc on medical notes can have future implications for life insurance/medical reports etc.

    Wich is why she need to get her friend to the doctor to be assesed wich it is because the OR will not excuse her for just wanting to avoid the situation, yet if she is dpressed, (dont know why you have latched onto stresss:confused: ) then the OR may allow some time to 'get herself together' so to speak. It wont get her 'out ' of anyting either way but will detirmine wether she ends up in court

    she is not ignoring her problems, she has tried to deal with them but it has all got a bit much for her.

    First of all we need to find out whether there would be any point to a "power of attorney in this case".

    We are talking about the Official Receiver investigating the bankrupts affairs here, not signing cheques on their behalf.

    And I wouldn't at all be surprised if the person in question here was very depressed. They certainly sound like it.:rolleyes:

    ok guys, so providing she gets the doctors note and gives it to the OR, wil the OR extend the bankruptcy and how long will the extension last for ? I know its usually 1 year but will the OR make it last even longer due to her stress/depression?
