Receiving unordered goods

I recently bought an item online, which I picked up at the store but a courier also came with the item, it looks as if the order had been duplicated.


I only ordered one item, the supplier only charged my credit card for one item, but somehow it got processed twice and I received two identical items.

Am I legally allowed to regard the 2nd item as a 'gift'? I know in certain circumstances you can, but is this one of those circumstances?

Anyone know of any sites which would clarify this matter?

    No you're not entitled to it. It was simply an error, not unsolicited goods. If you want to do the right thing and be honest, take it back to the store.
  • Inform the online part of them that you have received the item by mistake and that you are more than happy to make the item available for collection at times that are convenient to you.
    As long as you make every reasonable effort to make the item available for them to come and collect it, then I believe you are covered legally, if not morally (I am NOT a lawyer).

    It's their mistake, there's no reason at all why it should cost you anything to return it to them. This includes making yourself available for them to collect it, it has to be when you'd be available anyway. Remember to get a signature for anything collected from you also.
    There *may* be a reasonable period of time after which you can treat it as an unsolicited gift after making it available, possibly 6 months (again, not a lawyer, check with Trading Standards).

    Ive had duplicate items sent 3 times now from Play.com.and i only pay for 1 item. they dont seem surprised when ive phoned to tell them it keeps happening and says they dont have much problem with this and only one item seems to be noted on my account! ive sent back all 3 times at £1.40 postage each time but only been paid back once! so much for honesty. i,ll keep the items next time cos i dont see why ive got to be put out like this and out of pocket when i send them back.hopefully it,ll be the Wii ive got to buy soon!it will be they,re fault.:rotfl:
