putting a Charge on house after bankrupt order issued

hi

A court hearing is due tommorrow (28th) for one of my creditors to place a charge on my property, I have sent the court a copy of my bankruptcy order issued on the 22nd of this month.
Does anybody know if the charge can still be placed on the house without reference to the bankruptcy order.

  • The court should follow Clarke v Coutts and Roberts Petroleum v Kenny and not make a final order if the defendant has been made bankrupt. Have you notified the creditor that an order for bankruptcy has been made?

    Yes, they have been informed by our solicitor. Thank you for your quick reply.
  • Hopefully the creditor will realise the position and ask for the interim order to be discharged.
