Change of name Deed poll and CRB Checks

Hi,

If someone changes there name through Deed Poll, and goes for a job with there new name with a CRB check being carried out, what happens if that person has a criminal record in there old name? Because for all I know there is no national register of change of names, and it requires the person themselves to inform the police of change of name.

The reason I ask is an old school friend has started working in our bank, yet with a new name, and I know he has been done for theft before and been of comminity service in the last year, which would therefore mean he would have no chance of getting the job if they knew that.

    Well if he doesn't put his former name on the CRB form in the section that asks for other names he's been known by, he's committing an offence but then he has already shown that he doesn't give a damn about the law.

    If it really worries you that much, maybe an anonymous letter written to the manager...

    No I don't want to get involved, well I don't know if I should. It's really bad situation. My head says I just got to say, my heart is saying I shouldn't and keep my nose out of it. lol

    Strange that theres no national register or anything.

    Surely the Bank has failed to follow their own protocols, he would have had to supply a 10 year work history and be credit checked (I'm sure all financial institutions do this now).
    He would fail the credit check if he only had a year history, just for a start.

  • It is highly unlikely that his deed poll is even legal, most aren't. People pay their couple of hundred quid to a solicitor or, I believe £20 on the internet for a piece of paper, quite literally.

    Not sure of all the technicalities, perhaps someone else is, but a legal deed poll has to go through the court and ends up with a couple of stamps which certify it, I can assure you there are not that many about in context.

    With that piece of paper you can change your passport, they just want to know the reason for your name change ie. don't wish to be associated with family members, don't like it. Change bank details, apply for jobs etc. The only thing that will stick with you is your NI no.

    There is no central point which co-ordinates name changes. People assume that the Registration System (Births, death & marriages) accounts for this, but no. They exist purely for the purpose of family history, traceability and National Office of Statistics. Only if you get married would you need to detail all names by which you have been known.

    It is extremely easy for people, namely criminals to slip off the radar. I watched a documentary on it once, can't remember which tho.

    In your case OP, i think it is purely a question of conscience and are you comfortable working with him. Would you think of him first if a purse went missing? OR does everyone deserve a second chance, people do change and perhaps putting away your old life and name come hand in hand. If he knows you know him, he must perhaps be a little worried about you outing him.

    You have to put you and yours first and after all, work is work, do you really need to give yourself any hassle. Tough one, don't envy you.

    You are totally incorrect, in the UK, Deed Polls and name changing has nothing to do with the courts. It is legally possible to change your name totally independent of any company, and using your home-made Deed Poll change all your official documents like Passport and Driving Licence. The only document that cannot be changed is the Birth Certificate.

    Perhaps you should do a google search on "deed poll" and read up up on the process.

    Actually, the bank will probably catch him out sooner or later. He will need to provide evidence of good financial repute; under the way that banks interpret the FSA regulations, that will usually mean a credit check rather than a CRB check. His credit rating is likely to be poor.

    Now, he will also need to provide proof of his entitlement to work in Britain; and to do that he will need to provide either a passport or a long birth certificate/plus other document. It's very difficult to avoid showing a link between current and past names in every single document that needs to be shown.

    As for your conscience, my business head says have a quiet word with HR; my common sense head says that the banks employ a fair number of crooks and accept that there will be a certain amount of fraud that they'll have to pay for, so what's the point of saying anything if you prefer not to!
