Preparation for the issue of a CCJ

So a close friend of mine has some debt issues and I want to help her resolve them. We lived in a houseshare until last year, since when we have still recieved a lot of her post. Yesterday another housemate accidentally opened a letter belonging to my friend, this letter was from a Credit management company explaining that they are preparing a CCJ against her. My question is what now? Is it simply a case of contacting the credit company and negotiating with them, or does she need to also speak with the county courts?
My friend has been particularly niave and stupid in all this, and I think she needs some strong guidance, what should her first steps be?

Welcome to the boards!
First of all just sounds like a scare tactic, does not sound like a CCJ yet! If your friend is unable to pay the full payments then she needs to put together a financial statement this will detail ALL your friends income and expenditure. The amount she has left is the amount to offer her unsecured creditors.
If your friend has more than one creditor or needs any help completing a financial statement CCCS have a free online debt advice facility called Debt Remedy – does not take too long to complete and it will let you know the best solution for you problems. This link will take you directly to Debt Remedy.
Your friend can check if she has a CCJ by contacting one of the credit reference agencies (Equifax, Experian, Call Credit). If she does and has not been paying it she will need to get a form called a N245 to vary the judgement to amount she can afford then this debt needs to be treated as a priority.
If a creditor is applying for a CCJ it’s all done through paperwork and would be a blue and white form she would receive through the post. It would ask for details of your friend’s income and expenditure and an offer of repayment, the amount to offer would then be an affordable amount based on her income and expenditureI am a Debt Counsellor that works for the CCCS and have specific permission from Martin, to post on these boards to try and help those in debt. I am in a similar poition but the people would not negotiate and also added loads of charges. I had to leave my old address suddenly due to domestic issues and am still NFA in a different city and have a new name. But my mail is being forwarded now, as it was not before but the new people living in my old flat are doing this for me so what would I do; they are threatening a CCJ within 7 days and I don't know when the letter is from. I am not able to work and cannot survive on my £46.85 a week income support as it is and often go without food so canthey really do this to me?0

Sorry to hear about your situation. The same advice goes really. You need to double check that you have not already got a CCJ by checking with the credit reference agencies. If you have or if the creditor chooses to go for a CCJ then this will be based on your income and expenditure so will basically be set at an affordable amount for you, so even if you can only afford £1 offer £1 as the court is there to be fair and set a realistic payment amount, they are not going to make you pay more than you can afford.

But I do not have any debts other than one overdraft within its limit and one DSS crisis loan which is already being repaid automatically every 2 weeks.0
