Old Debt

Can anyone give me any advice. My parents house was repossessed back in 1993, we were all on the deeds. It went to Court, but no CCJ raised. Both my parents have since died, and the company, national Home Loans contacted me for me to pay back the shortfall, which is £36,000 ish back into 1997. I was a single parent and money was tight, so I completed their income and outgoings form and they agreed to £1 a month. This has been paid every month via standing order to them with no problems. Last time I heard from them was in year 2000 when I moved, advising them of my new address as I was living in a Housing Association property. I have just received a letter from them recently saying that I need to contact them with regard to making an arrangement to pay them back more money, and I have to contact them. I got married in 2005, and both of us are on low incomes, and I am worried that they might ask my husband for the money? Can they do this. I don't really know what to do cos they don't know I am married, and also can they ask for more money from me.

Can anyone help.

Many thanks.

You need to take some proper advice on this

    See here http://www.moneysavingexpert.com/loans/debt-help-plan#help

    as a starter.

The situation round repayment on mortages is difficult - in some instances 12 years although most companies do not pursue after 6 years.

So you need to check it out with a legal professional.

There has also been a case recently where a bloke who had not paid got squatter's rights but he was still living in the house and it was more then 12 years since he defaulted and the creditor had not pursued him.

in the mean-time do not contact them by telephone.

Re your OH, they can only ask him to pay if his name was on the deeds; who is we were all?
If you've have not made a mistake, you've made nothing
