Rights after maternity leave

Hi,

My wife & I were wondering if anyone would be able to help? :confused:

We are thinking about having children & are trying to plan ahead. My wife currently works full time & will go back to work part time after maternity leave. She has worked for this employer for 5 years.

Does her employer have to give her the same job (part time obviously) or can they put her in other departments within the establishment? Also, if they do move her, are they obliged to keep her on the same wage pro-rata or can they reduce her wage to fit the position?

    Your wife will only have the right to request flexible working and not the right to automatically get it.

    If she takes OML she has the right to return to the same job, if she takes AML then it only has to be a similar job if hers is no longer available.

    If she is unable to return to her original post part time for business reasons, then they can offer her any other part time positions but dont have to keep her on the same terms and wages as it will be treated as a new post.
