Thames credit / Aktiv Capital ?? Debt Letter for debt not owed?!! HELP!!

I have just received a letter addressed to my sister, but delivered to my house (not even sent to my correct address, but to a house down the road from me with her name on it) from 'Thames Credit Limited' in Bromley, Kent, acting on behalf of Aktiv Capital.
They say they have bought a debt from HSBC bank that my sister owes for £113.82 - now I know this is not a lot of money, but it is for my sister.
A few years ago she got into difficulty with HSBC and had her overdraft turned into a managed loan. She paid off £20 a month for this, and the debt was paid off over a year ago.
Can anyone tell me about this 'Thames Credit Limited' - are they a genuine company, or should she be wary?
I am very VERY worried about ringing her and telling her all this, as she owes HSBC nothing!!!

Hi, try not to worry there will be a solution. Does your sister have any paperwork regarding the settled account? Does the account show settled on her credit report?0

I am presuming she has paperwork somewhere, I have told her to go into HSBC and see what they have on their records.
The thing is, she doesn't even have this bank account anymore!! So I cannot see how they are saying that she owes HSBC money and that they have bought the debt

There are a few threads on here re Aktiv...have a look at one of those...if it refers to a loan she can always ask for a copy of her CCA ....BOI Credit Card = Was £3500.00 Now £0.00
GE Capital Store Card= Was £1800.00 Now £0.00
GE Capital Store Card = Was 1300.00 Now £0.00
Credit Union Savings Now £200.00 :T0 -

Thames credit/Aktiv could be collecting anything, it could even belong to someone else, knowing their hit rate.
First things
She needs to send a CCA letter to Thames credit ltd - see the info below..
Consumer Credit Agreement. Has to be supplied or the debt is unenforceable.
So this is what you send, recorded delivery, print your name. If they do not send the complete and proper documentation back with the time limits, you have to pay nothing.
Please do not sign it, just print your name. We have instances reported here when the returned sig was that of the person who sent the letter and not the putative debtor!

We understand that under the Consumer Credit Act 1974 (Sections 77−79), we are entitled to receive a copy of our credit agreement on request; your obligation also extends to providing a statement of account. . We enclose a payment of £1.00 which represents the fee payable under the Consumer Credit Act.
2. A signed true copy of the deed of assignment of the above referenced agreement that you allege exists.
We understand a copy of our credit agreement should be supplied within 12 working days.
3. You are notified that you are obliged to supply these documents, whether you are the original creditor or not under S189 of the CCA 1974.
We understand that under the Consumer Credit Act creditors are unable to enforce an agreement if they fail to comply with a request for a copy of the agreement under these sections of the Act.

The one pound is the statutory fee that you have to send to pay for the CCA. it must be sent registered mail or special delivery and check when it is received.
The DCA have 12 working days plus 2 to respond to you before they are in default. 30 days after that, you can tell them where to go, rather firmly.
Secondly,
Sending a letter to an address at which you sister does not live (assuming she has never lived there) is out of order and she needs to complain about this.
Thirdly, is she still able to reclaim bank charges on this account?If you've have not made a mistake, you've made nothing0 -
Hi Guys
Thanks for the information given on this company. My wife got into a bit of trouble just before i met her with her exboyfriend around 5 years ago now and in short had a debt with Lloyds TSB for £2600.00DR. We have been paying this debt off for coming up t two years now with a debt agent called Connaught Collections at £125.0 per month, however this month she has received a letter from Thames Credit Limited stating that they have taken the debt off Lloyds TSB and that she owes an amont of £1405.00DR.
Im finding this difficult to beleive on the basis that I cant believe Lloyds TSB would go through two seperate collection agencies and we are currently paying the debt off with another company. I have drafted a CCA letter (shown above) and im going to send a £1 y recorded delivery :mad:.
Does this seem like the appropriate action to take? and likewise does anyone else have any simular experiences with them?
