Cca For Catalogues?

What way does requesting CCA work with say catalogues like Kays or even mobile phones when nothing was signed etc?

    1. Catalogue debts - Beware of these as the law has now changed (Consumer Credit Act 2006). If you took out the catalogue before 6th April 2007, then it is certainly covered under the Consumer Credit Act and requires a copy of the signed cca to enforce the 'debt'. However, if you took out your catalogue after 6th April 2007, then the Courts must decide as to whether a signed cca is required to enforce any debt:

    2. Mobile Phones - these are NOT, normally covered by the Consumer Credit Act as they are 'Consumer Service Agreements' - unless the agreement includes an 'instalment' plan to purchase a phone, in which case it then becomes a normal hire purchase agreement and is covered under the terms of the Consumer Credit Act.
    However, most 'providers' would, usually, split the hp aspect from the service aspect, giving you, effectively, two separate agreements - one Consumer Credit Agreement and one Consumer Service Agreement.
    Thi does NOT mean that you can not contest any aspect of a mobile phone 'debt', but you would need to go down the route of the SAR (Subject Access Request) rather than the cca route.

    There may, although I don't think so, be slight differences in Northern Ireland.
    I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
    If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.
