Can someone given me a bit of advise please

Just woke up this morning with a letter from court on my door step from Natwest.

The debt is in my husbands name and they are claiming 28356.18 my usand has ben paying natwest £150 a month for the last year and has struggled meeting that amoount of money. We have asked them on several occasions if they would be willing to stop the intrest and they wont so the debt keeps on rising. My husband has said when he phoned them last year to ask for a redemption figure he was given 18,000 so he does not understand this figure.

I also have unsecured debts which are currentl running through payplan (it was something i arranged when we split up in August last year)

We both are worried that we hay lose our house or they will ask for all of the money in one go. My husband only has this debt and one for a natwest credit card at £3,000 as he used the loan to consolidate other cards etc he aad about 4 years ago.

Any advise on what to do would be great. As the loan is just in his name will the court want to know all of my details too! HOw long will it be before court. Sorry to go on im just really worried.

My husbands income has been a bit up and down over the last year as he works for a family buiness and they owe him aprox £5000 from the company that was closed down in June and another £3000 from the existing company.

Will the court accept these figures or will they make us reduce them at all?

Can anyone think of anything we have missed.

are we able to fight natwest on the amount? are they allowed to claim all the intrest for the whole loan period?

Help would be really appreciated.

    Having a quick look at your SOA here's some suggestions. apologies if I make an error but not knowing what is and isn't manageable or cuttable I hope I don't offend.

    food £340 - set yourself a target of say £280 or £300. Save £480 a year!!

    food £340If you go to old style boards you should be able to reduce this by quite a bit. It takes a while to change habits but its doable!

    mobile phone £30qute high - go for PAYG if you can & use for emergencies only - 10 lasts me a couple of months

    Not sure if that helps at all? I would suggeest that you ring cccs etc for some advise & help. Is Oh taking responsibiity or is it you doing all the work? You say that you searated - I assume youre now back togeather? You need to sit down & tackle this togeather and get some advice. Its hard the sorting stage because its scary but you are taking contr of your money rather than it controlling you & while hard to believe its liberating!     This is the first written communication my husband has had from Natwest since way before christmas so im not sure if he has had a letter before action.

    Our home insurance is the best we can get as we had a major claim in march last year when our house burnt down.

    As for the mortgage we are on a fixed rate for another 2 years with ge money as we both have really poor credit scores.
    My mother in law gave up her job to be my childminder so this is her only income and about 2 times cheaper than nursery to look after ymy 2 children from 7 am until 7:45 pm 4 days a week.

    Can natwest make us sell outr house to pay this debt.

    Is there anything we can do about all of the intrest that has been added.
  • I think you need to ring CCCS as it looks like a formal debt management plan may be the way to go (see list at the top). Is there any equity in your house and was the loan a secured loan?
