  • Yes you can send mail recorded delivery to p.o. boxes (at least you used to be able to, not done it myself for a few months).

    Yes you can, MissEyre - I will try to find a link, but the Post Office should know.

    The Debt Collection Agency is legally obliged to provide you with full details of any alleged debt, including a detailed statement. By requesting this, you will have put the debt into dispute and they can not continue to pursue you, even through the courts, until they have supplied the required information.

    Yes you can send Recorded Deliveries to a PO Box but I would always go Special Delivery

    Thanks everyone, have sent the letter first class recorded delivery so will just wait and se what they have to say next.

    I know it's quite a small problem in relation to some of the issues people post on the boards, and I really appreciate the support-instead of just panicking and getting upset, I am confident that I have done the right thing, and will let you know when I get my next letter from them.

    It's always better to deal with a problem while it is small, ME - like children, problems have a habit of growing into large ones before you realise.

    Hello again,
    Right, have got home to find another letter from them-they are sorry that they haven't heard from me, the original charge has now increased to £680 something, and they are going to hand my details over to their litigation team to deal with, which could lead to even more charges. I sent them my letter recorded delivery first class on Saturday afternoon and have checked on the royal mail site, but it hasn't been delivered to them yet. Do I just sit and wait till they've got it, or should I send another response to this second letter?
    Thanks in advance for any advice!

    Don't worry - if you sent the letter by recorded/special delivery, you will be able, should you need to, to prove that they have in fact received it. By sending the letter, you have placed the 'debt' in dispute and the dca can not commence 'litigation' whilst the 'debt' is in dispute. If they were stupid enough to issue a Court summons, all you would need to state, in your defence, is that you were unaware of any debt and have written to the dca requesting a true signed copy of the cca in order that you can see, for yourself, if the 'debt' is indeed genuine. To date the dca has, seemimgly, ignored your request and has not provided you with the relevant documentation, as was their legal obligation under the terms of the Consumer Credit Act 1974. The Court would be obliged to rule against the dca.
    In the meantime, do NOT reply to their letter - keep it, and any further letters, in case you need them as proof of harassment.
