Ok many moons ago I had a lloyds account with an overdraft, Ive not used this account for over 6 years. When I moved house October 02 I never got around to telling them I moved. Actually in fact I made an appt to see bank once I had moved, had to phone them and get appt couldn't just drop in. When I went into branch they said how can I help Miss x and I said Well actually Im now married but I want to inform you of a change of address. They said they couldn't discuss the acc until I proved I was now married and said person. Was so annoyed they got me into bank, out of work and then to be sent home...grrr. Anyway I never contacted them again and haven't heard anything from them since my last statement July 02.
I had received a letter today from Apex (formerly BCW group) which happens to be one of my creditor on my DMP, to say they are now instructed to collect this debt from Lloyds.
So where do I stand? its just under 6 years but I haven't used the acc for over 6 years and ive never had a single letter before today about this account. Whats the best way to proceed with this?
Thanks guys

If it is over 6 years since you acknowledged the debt in writing or by making a payment, then the debt is "Statute Barred" under the Limitation Act 1980.
See this link to a factsheet and letter to write if you think the debt is barred.

(Note: If you are in Scotland it is 5 years not six, and the correct info is HERE instead)
If the debt is "Statute Barred", then they can ask you nicely to pay it, but they can't take any other action.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB
