Send them the letter that you will find on the following link (thanks to weller711):

Send it to Assett - keep a copy, and ignore the 'new' company. In the UNLIKELY event that they 'take you to court' the court will have a field day with Assett.I am NOT, nor do I profess to be, a Qualified Debt Adviser. Ok will get it done

On thinking it was the statute barred letter I sent them. The one about the 6 year rule (5 years scotland) I take it this still applies though and will get it sent off asap.
Ive never had debt before. What a nightmare0 -

No, ickledee - that letter will only apply if you have requested a cca. If you have sent the 'Statute Barred Letter' then you need do nothing, until, and if, you receive a reply from Assett.
I'm off to work, soon, but I'll look in on your thread tomorrow, and think of the best approach - certainly a complaint to Trading Standards, seems an option - plus there are sites which advise on removing defaults.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I've been reading your posts with great interest. I too have been a victim of Lowell! I have never had any dealings with them, I do NOT have any outstanding debts, I don't even have a credit card - Lowell appear to have confused me with someone else with the same name and date of birth who are less than saintly with their finances.
At this point, I find myself unable to re-mortgage my home (so am stuck with the current variable rate) and I am unable to get any finance whatsoever and have been 'black-balled' by just about everyone! I have written to them and phoned them on numerous occasions and can't get any sense out of them at all - they sent me 'proof' that they though they had the right person but it was just a signature (not mine) at a different registered address. Other companies are now making the same incorrect link and I'm literally being drowned in a sea of threatening letters and have an inability to procure any sort of finance from anywhere!
Does anyone have any ideas??0 -
Hi,
I am new to the site.
Wanted to say that I have just started to receive letters from Lowell Finance Ltd [well only 2 to date] and they have been forwarded to me from the company I worked for in the UK, you guessed it I am now living outside of the UK/Europe. Not heard from the original Bank in it must be almost 6 years. I wanted to have this paid at the time but the charges just kept being put on and on and hence the original debt which was small ended up being almost 2 thousand pounds. Then I stopped hearing from the bank
Second letter threatens litigation speacialists Hamptons Legal. First letter I just shredded it, now I am concerned that they may try to find me via family or friends from back home. I went through a bad divorce etc., and 3 children no help from ex and life was really bad. Now everything has turned around and life is great,.
Should I contact them and let them know where I am can they collect the debt even though I am living outside of the UK/EU. I am working for the same company that I worked for in the UK, can they contact my old emmployer [as this was the address c/o.....] and demand to know my last know address. Also they have written to my in my maiden name, I have since remarried and they obviously do not know this.
I am so worried now, that I am not sleeping, should I contact them and let them know where I am i.e. my overseas address etc.,

Hamptons Legal are just a trading name of Lowells, not a real legal firm, so any threats from them is likely to be hot air.
If this debt is nearly six years old, then it is likely to be "statute barred" and legally unenforceable very soon. It may even be already.
Read through the info in this link:
http://www.nationaldebtline.co.uk/england_wales/factsheet.php?page=25_liability_for_debts_and_the_limitation_act
Lowells are notorious for buying up legally unenforceable debt, and then hoping that you just pay up before you realise you don't have to. Complete bunch of ****s.
Personally, I would just ignore them until you are sure the debt is "statue barred", then send them the letter in the above link that tells them to "get lost".Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB
