TERMS & CONDITIONS OF ENTRY
1. The promoter is Micro Focus Limited, Old Bath Road, Newbury, Berkshire, RG14 1QN, UK (“Micro Focus”)
2. This free prize draw is open to anyone who completes an entry form except for employees and their families of Micro Focus or its group companies, their agencies or any other person involved in the administration of the prize draw. Entrants must be aged 18 or over and only one entry per person will be permitted and must submit their entry form to the following address: infocus@microfocus.com.
3. No purchase is required in order to enter.
4. Entry registration is based on the following information being provided: name; job title; email address; company name and full business address. Incomplete entries will be disqualified. Entry is via email.
5. By entering the prize draw, the entrant warrants that all information submitted is true, current and complete.
6. Responsibility cannot be accepted (and Micro Focus shall not be liable) for lost, delayed or inaccurate entries. Micro Focus reserves the right in its sole discretion to rule ineligible any individual who tampers with the entry process or otherwise attempts (at Micro Focus’ discretion) to interfere with the proper conduct of the draw.
7. Should the entry be invalidated or cancelled at any time during the stated promotional period, the entry will be removed from the prize draw.
8. There is one (1) prize of one (1) iPOD Touch.
9. Closing date for receipt of valid entries is February 23rd, 2008. The draw will take place on February 25th, 2008. The winning entry will be drawn independently and at random from all valid entries received. The winner of the prize stated above (see section 8) will be the first entry drawn. The winner will be informed by e-mail within five (5) working days, using the address provided in the winner’s entry.
10. The winner must respond by e-mail to Micro Focus to confirm the winner’s prize-claim within 15 working days of Micro Focus sending the prize notification e-mail. The winning entrant must respond to the address detailed in the prize notification email from Micro Focus. Should the prize winner fail to respond in accordance with this section 9, the prize will be withdrawn and the winning entry will be void. In the event that the initial winning prize entry is void in accordance with this section 10, Micro Focus will then award the prize to the next valid entry, which will be drawn in accordance with section 9 above, and by using the same notification and confirmation process (with the same consequences for the entrant of late or non-receipt of confirmation by Micro Focus) as detailed in sections 9 and 10. No further entry will be drawn if the second-drawn entry also becomes void for any reason and the prize will cease to be available.
11. The winner is responsible for all taxes related to the prize. Micro Focus will take responsibility for arranging the delivery (without insurance) of the prize stated above (in section 8) to the business address detailed
in the winning entry but will not accept responsibility for any damage caused in transit or by third parties after the prize is delivered by Micro Focus to the courier or mail service.
12. Micro Focus shall not in any way be liable for damage, loss or injury resulting from acceptance or use of the prize. The winner acknowledges that Micro Focus provides no warranty, representation, or guarantee whatsoever (in all cases, whether express or implied) in respect of the prize, including but not limited to the quality, merchantability, mechanical condition or fitness for any purpose of the prize. Nothing in this term shall however exclude Micro Focus’ liability for death or personal injury caused by its negligence or for fraud.
13. There is no cash alternative to the prize stated above (in section 8) or alternative prize available and the claim to the winning prize is not transferable. Micro Focus reserves the right to substitute a prize of equal or greater value at any time.
14. Micro Focus reserves the right in its absolute discretion to extend or cancel the promotion and/or draw if such action is required due to circumstances, including (but not limited to) technical problems or the operation of any aspect of this draw or for any other reason, beyond the reasonable control of Micro Focus which adversely affects (or is reasonably likely to affect) the administration, security, fairness, integrity or proper conduct of the prize draw.
15. All entrants in the prize draw agree to: the publication of their name and their company name in any promotional material associated with or resulting from the prize draw: and to the availability of their details upon request by any other entrant after the end of the promotion.
