debt sold on from my bank

Hi just looking for a bit of advise what to do hear.
I took out a £3000 unsecured loan in aug 2003 and was keeping up with my payments as i had quite a good job but then i got myself into a bit of trouble and was put into prison and also lost my job. i informed my bank straight away that i couldnt keep up with payments as i was in prison. i was charged default payments until the prison confirmed that i was there.
i had been away a year and half and a few months of being home i got a letter from a financial company saying the debt had been sold to them and to make full payment. i contacted them to find out what was going on and tell them i had been in prison and lost my job so had no income. the person on the phone said they would put it on hold and then recently i have had a another letter saying the same thing. also the balance seems to have gone up a £1000.
they asked me to pay something little until i get a job but i cant really afford to and i am not going into an agreement until i get advice first.
i have read a few forums on here saying you dont have to pay these people back, on my credit report it has my loan with the bank settled but nothing of this debt with the financial company.
i would really appreciate any advice. thank you.

  • I'd contact your local CAB. I take it your claiming benefits? if so inform the finance company of this, and try to make a minimum payment, even if it's a pound a week, they'll still be getting something til you get back on your feet.

I would request a notice of assignment and a CCA from them . Template letters are available . Read posts on CCA REQUESTS and what it means.
