Claiming back extra years pension

My pension is with the Police Pension Scheme.
I worked in the Civil Service late 1982-late 1983 then in the Ministry of Defence Police late 1983-Dec.1987. Civil service pension transferred to MOD Police.
At the end of Dec. 1987 I started working as a Police officer in a home office force, transferring my pension from the MOD Police to the regular Police Pemsion scheme. I was told that the service credit entitlement was 4 yrs+260 days.
Around about 1992 I received a letter stating that the Police Pensions (Amendments) Regulations 1990, operative from 1st May 1990 but retropectively effective from 6th April 1988 introduced new factors for the calculation of pensions which affect the calculation of service credits.
As a result of the new regulations my revised service credit entitlement was 3yrs+195 days.
The letter stated that 'unfortunately, the County Treasurer did not receive a copy of the new regulations until Octoder 1991 and advice had been sought as to what to do in relation to cases like mine where officers had been notified of service credit calculated on the basis of the new formula. The conclusion was to recalculate according to the new regulations'.
My first question is, would I have received a transfer service credit within 4 months of starting the home office force thereby falling outside the date of the new regulations?
Last question, even if the answer to the first question is no, does anyone have any knowledge of how successful I would be in re-claiming the lost 1 year+65 days?

    I don't think you're going to get a legal interpretation [SI's are laws after all] you can rely on an internet forum - not even one as good as this one.
    Have you contacted the Police Federation? They should be able to refer your query to their lawyers some of whom specialise in Pensions and Statutory Instruments.
