hi back again....
Luckily I got straight through.....had some great advice. Unfortunately as its less than 12 years they can chase me for it (as has been mentioned) but I should ask for a letter detailing the shortfall and when the exact date property was sold etc, any interest etc etc.
The problem is I don't know if it was a baliff at the door or not as since moving house they could have had CJJ against me....I have been advised what to do if its a DCA or a baliff...but must admit I am still really scared....
If it's a DCA I'll tell them to leave and that I will correspond in writing only....if it's a baliff I can ask them to return to their vehicle and speak to them there and not let them in to my property, quering the amount I owe and that I wish to see in writing the amount etc...does that sound right?0 -

The advice from NDL sounds pretty fair to me.
Shame that the advisor didn't think that you would have much luck arguing the whole "Counsel of Mortgage Lenders policy" argument with them, but I suppose if it has gone as far as a DCA then it's past the point of listening to voluntary guidelines.
It's unlikely to be a bailiff yet, and they normally like to let you know they are bailiffs because they know that scares the life out of most people.
It's more likely to be a tactic to try and get you to speak to them on the phone, and in doing so have the chance to try and bully you.
As NDL advise it's best to do everything in writing.

It's unfair enough that you are having to cope with his debts already without more popping up without warning.
I've only just noticed that you are on a DMP with CCCS.
If you are going to have to come to some arrangement with the DCA/creditor then you will need to talk to CCCS regarding this and the DMP anyway.
While you are doing that you can take the chance to ask CCCS's opinion on the situation as well. A second opinion in these cases is often worthwhile, even if it is to just confirm the original advice.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

like you ... this is where my debt came from they didnt contact me for 10 years then came down on me and wouldnt let up !!! in the end i took advice and went bankrupt with my other debts (mortgage shortfall was in excess of 15000) the advice i was given at the time (3 years ago) was that they could pursue me for up to 12 years with a mortgage debt and i couldnt take no more hassle it was also very painful for me as it raked up a bitter divorce and breakdown ,no money and trying to support 2 little girls !! i think they only started coming after me because they thought i owned a new property (its my bfs) i had been in the same place all the years before and never once sent a letter so i was unaware i even owed anything !! good luck . paula x0
