OKay , we can sort this out !. BARCLAYCARD get DCA to collect bad debts .If that DCA fail to collect payments ,BC often recall the account , then simply pass it another DCA . The thing to now do is concentrate on the new DCA , forget BC for now . They will not deal with you now its gone to a DCA . Keep all leters recieved and keep copies of letters sent . DO NOT SIGN ANYTHING . DO NOT RING THEM ! NEVER GIVE THEM YOUR NUMBER . AND MOST IMPORTANT NEVER EVER PAY BY DEBIT CARD .

The next thing is to send a CCA and Notice of assignment request ! This will put the account in dispute. Nothing can be done on the account until a copy of a signed credit AGREEMENT is produced. I will advise further after you have read my post LETS ALL ASK FOR OUR CCA . GOOD LUCK

Hi there I wondered if you could help me. I have sent barclaycad request letter for CCA which the 12 days is now up. I have not received a response from Barclaycard and I am now wondering what to do from here. Do I send out another letter? or do I wait, not sure how to proceed now. Receiving phone calls from barclaycard asking for payments but just telling them that we will not pay anothing because we are waiting for our CCA which they have not sent us. It has not gone to a Debt Collection Agency and Barclaycard are still dealing with it. Can anyone help? We took out card in 2001, there is £2,000 outstanding approx.

    Thank you

    Hi

if you took the card out in 2001, when did you last make any payments towards the debt?

    This could be statute barred.

Hi there, we have been making the minimum payments up until 2 months ago when we realised that the CCA might not be enforceable. It is ridiculous that in 7 years the balance has only gone down by £500 (bloody interest!) The 12 days +2 is up on Wednesday and I was wanting to know where to go from here.

    Thank you.

    Thanks for the response.

There are two options after he 12+2 days

    1. Sit on it but stop paying them, as you would be entitled to. The down side is that if they KNOW that it is not available, they may sell on the debt in the next month.

    2. Write the 12+2 day letter telling them you are not paying and that they are forbidden to pass on the debt to anyone else (IO), and remind them of the 30 day deadline. They might respond by making a bit more effort to find the documentation and there is no guarentee they will not sell on the debt.

Thanks for your reply, where do i find the 2nd letter that forbids them to sell the debt on?

    Thank you again.
