Hello again, just wanted to give an update of the latest...
Had a reply from my MP this week. Doesn't really give a committment to helping out. Just quoted some legislation which doesn't really apply. Recommended I appeal with the help of the CAB. Going to respond with a direct request for support to bring about a change in the rules...watch this space. At least he replied which is more that Gordon Brown has!!!
Had a very interesting letter from my OR today. They have written directly to the council, it's a cracking letter. Don't think it will prevent the appeal going through but wanted to quote this bit (sorry its a bit long):
"By including this extra money, which shows in his wages as disposable income, has meant he is unable to comply with his agreement, arsing from the court ordered bankruptcy, and the OR due to this change in his circumstances has had to suspend his payments under this agreement to enable him to maintain his household."
"The OR therefore believes that you are having the benefit of monies that would have been due to his creditors had you not stopped his benefit and requested the overpayment".
I think that will help with the appeal. And at least the OR has taken some steps to try and help sort this for us!!:T0 -
Thanks for the update. Good on you for campaigning on this, you are not the first this has happened to and I am sure there are a lot more out there who have had these problems.
MP's I have found from personal experiance are about as useful as chocolate teapot  .

Thanks TF, you're right about the MP's. Loving my OR today though! It's a great letter. I particularly like a bit where they "request a prompt response within 14 days". :rotfl:
It's also great that they're keeping me in the loop...can't wait to see the response!
Figured I might ask someone from the OR office to attend the appeal...I can but ask.0 -
If you don't ask you don't get
Why don't you fire off a quick PM to JSC1 to ask if he thinks it is feasable.BSCno.87The only stupid question is an unasked oneLoving life as a Kernow Hippy0 -

Hi all, i'm new to this but all this is exactly the same as my problem, although not as higher figure but an amount of £650.00 owed due to NT tax coding. The OR was good in giving me a 2 month payment break while i am trying to sort out this problem with the council. My appeal is on the 7th April so i have just sent a letter to the appeal office stating the quotes DD gave a few posts ago. I feel for everyone on here, no-one has wanted to go BR, and now we are all fighting for our lives. Will let you know how i get on.0

Hey fellow "fedupwiththecouncil". As awful as it sounds...it's great to find someone in the same boat.. ...That's why this thread is here!
Ridiculous situation eh? What did the council come back with as their argument? How long did you wait for the appeal to come through?
Please keep me posted with how you get on..xxxx0 -
Well Chazpots, I hope the letter from your OR carries some weight in your appeal, its a shame your MP didnt take a little bit more interest in your case !
I will keep watching for the outcome............Goodluck as always !
That goes for you to 'fedupwiththecouncil'0
