new partners of divorcee's with outstanding unresolved asset division

hi this is a brief synopsis of the problem i am moving in with my partner who is pregnant with my child and her two children from her marriage
she was divoced by her husband a year ago but they did not sort out a financial settlement on the property at the point of divorce. she earns to little to borrow more from the mortgage company to pay her ex off and the ex is demanding 50% of the property now.
the property is worth around 160k with a 35k mortgage and the ex has not paid any thing towards the mortgage for three years allthough i beleive he had been contributing for the 7 years prior to this.
I am a disharged bankrupt in full time employment earning 22k+ would a mortgage lender take into consideration my earnings in relation to my partner applying for an extension on her mortgage (lender Hallifax) we are in the process of aranging to be married. I am currently unable to even gain a basic bank account.?
could the ex place a 2nd charge on the property and use this as a deposit for a new mortgage?
