debenhams card/ ge capital unfair charges

i put a post on here a week or so ago about how ge capital have been charging me for insurance i didnt know i had, I didnt want for the past 3 or so years. They have also been charging me every time it hasnt gone through £12 it turns out.

My limit was £250 and I have been paying £11 a month for over 3 years thinking I was paying it off. Turns out I now owe £300!!! I must have paid £400.

Anyway I sent off asking them for my summary of all the charges and said i was closing the account. I had also made a phonecall earlier that saying saying i would pay my next bill at the end of the month instead of that week, but I would pay it in full then. I asked on the phone for all my charges to be sent to me too and my insurance to be cancelled.

Now all I have received is a few pages of the terms one day, and today my statement. The statement has charged me for a late payment even though I phoned and wrote to arrange a later date. The insurance has not been cancelled. There is two pages of the same statement that goes back one month, why would I wnat two copies going back one month?! They have charged me £3 for this.

How do I actually go about getting back all my charges and insurance? I have read a bit about it on the website but I really dont understand. How do I know if the insurance was mis sold? I didnt want it and it was never explained to me, and I have never claimed on it as to be honest I dont even know how I would claim. I havent used my card for 3 years. I used it a few times the month I got it then left it.

Somebody please help and give me the idiots guide to getting my money back from GE Capital!!

  • right they have sent me my old contract so I can see it.

    Basically i was a student and not working when I took the insurance out. Now I did not know i wasnt meant to have the insurance based on this so I was mis sold as she never asked me whether I was employment.
    BUT
    I looked on my contract and the SMALL (and i mean like font size 2 or something) print says:


    Before you begin, can you say yes to all these statements?
    yes i am 18 or over
    yes my partner or myself are on permanent paid employment.. etcetc

    .... if you have not answered yes to all these questions, please see a member of staff..


    I NEVER remember seeing this bit! I would have said no if I had! not only that but would i not have claimed unemployment by now if i knew i had unemployment cover??
    So my problem is that on a contract I blindly signed it mentions employment. yet I was never talked through it and was so rushed at the till I didnt have a chance to read it all, she just put x's where she wanted me to sign!

    Ok i was 20 and stupid and naive but surely they cant manipulate you into doing that. Even now ive found out i am paying insurance, its only today I actually realised it was for unemployment cover as well as that price protection crap or whatever it is.

    I know everybody would love to tell me im stupid, but if anyone actually knows my rights here could they help, surely all contracts have that bit on them and yet people have been mis sold cover for the same thing before.

    Help! At worst, say i really cant do a thing about it because i blindly signed it, you think i can claim for being unemployed??? The terms n conditions they sent me are so badly photocopied I cant read them properly!

  • Hi, I have found them very reasonable to deal with in the past. We have had ppi insurance refunded and a late charge refunded by ringing up. Admittedly our circumstances were slightly different than yours, but by being methodical and looking at the advice offered, you will get there in the end.
    Blackadder: Am I jumping the gun, Baldrick, or are the words 'I have a cunning plan' marching with ill-deserved confidence in the direction of this conversation?

    Your not stupid, most people dont realise theyre being ripped off till they see/hear the media attention. Banks have a canny way of getting us to trust them when in reality there after 1 thing. I would say you have been missold the insurance as you wernt employed anyway so there was no unemployment to cover unless ofcourse unemployment wasnt included in the cover, they clearly failed to ask you this and didnt explain.
