Hire Purchase AND CCA REQUEST

Hi Everyone,

Just a quick question really. I have been reading alot in cca request's and can only make a bit of sense with it. My question is that i have a car on hire purchase with welcome finance and i doubt they have all the relevant documentation that is required under a cca but would this still be the same as requesgting a normal cca to a credit card etc? eg stop payment after 12 days of receipt.

    It is a consumer credit agreement. Basicly if the creditor does not honour a request for a valid document in 12 days the agreement becomes unenforceble until it is supplied. 30 days after default of request the creditor then breaches the law commiting a criminal offence. Hope i got that correct. :o
  • Hmm, I see. And what happens if they don't supply it within 30 days? the debt is unenforceable for good? Is this a case of trying to prove a point, or is the intention to get the debt writen off without paying?

  • i think if its after 30 days its unenforcable..someone will be along soon hopefully that will clairify ;)

    Why do you doubt that they have retained a copy of your signed agreement?
    They normally supply copies with no problem. Did you keep one?
    You should check it carefully as there have been succesful challenges on enforceability of Welcome agreements due to such things as mis-stated amount of credit
