    Just because you did not get his name do not be put off from making a formal complaint. Like you said you can supply exact details of the time of call, his accent etc.

    If you get chance see if you can read through the following link and see if they have broken any more guidelines. And dont forget at top of letter so they cannot miss it "FORMAL COMPLAINT. You will be able to tell if they have treated it as such because in there response they should put a leaflet in about your rights and complaints. Also send it recorded delivery.     A charging order is nothing to worry about. Even if you are not keeping up payments, a charging order only means that if you sell your house they are paid before you get the rest of the money that you have sold the house for.

    A lot of secured loans come with charging orders already attached, that way the lender is making sure that the loan will be paid off somehow (I think that was before negative equity was invented). There would be no point in secured loans if you had to sell your house straight away to pay the charging order.

    Basically the bloke was talking through his bum. They can't make you sell the house. Also, if they do get a charging order, make sure it is taken off once you have paid them what you owe, or trying to sell your house if or when you want to will be a nightmare.

    It's so easy to say take a day at a time but thats what oh and I am doing.We have been on a DMP for 10 months and we are going to court over a CO for a c/c debt of 6k from NR. We are fighting it ,hang in there ,there's lots of people on here to give advice.

    Not read all replies so someone has probably said this ~ National Debtline website has lots of downloadable factsheets one of which is on charging orders ~ its become a part of my debt bible!!

  • massve great thanks to you all. I have calmed down a little now and i'm more rational!! I've read the link to the debt questions and realise it was a scare tactic.
    I'm going to complain though I work in customer service ad would have been sacked the way he spoke to me!
