    How much are these debts (roughly) and how much are you paying off each month to each of them?

    And are you reclaiming your bank and catalogue charges?

    didnt know you could claim catalogue charges? are these the "usual" charges that they add or just for late payments etc and no not started claiming YB charges yet althugh over the 3 yrs we were with them i think we would be looking at at least £1,000

    this is what i did earlier, will get details of how much left on each one shortly

    According to this, your finances are in rude health, although you have lots of credit from very poor providers. It would be a good idea to use some of your surplus to get rid of some of these debts.

    Get rid of the catalogues and go to Primark instead (please god forgive me for recommending exploiters of overseas workers).

    Pay off provident and never use them again. I assume that naylors is a similiar outlet? Can you pay them off early?

    I suspect that you old debts are reducing your credit rating, so you both need to get your creit checks and to see when they will start to clear. Since you have been in previous relationships, make sure that you are not longer associated financially with any of your exs.

    Here is a letter that you need to send to Capquest. Do not sign it, just write your name or OH if the account is in his name. It need to go by recorded delivery so you can track when they get it.

    They have 12 working days plus 2 to allow for the post in which to send you back a full CCa, plus the terms and Conditions and letter of assignment. There is a good chance that they do not have it. Expect a few letters suggestign they will take you to court etc, but keep calm and come back here for advice.

    Once the 12+ 2 days is up, ythey are in default and ytou must stop paying them. If they fail to respond 30 days after that they are breaking the law, you need to send them another letter and to report them.

    Your Ref:

    I do not acknowledge ANY debt to your company. I require you to supply the following documentation before I will correspond further on this matter.

    1. You must supply me with a true copy of the alleged agreement you refer to. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit) - your obligation also extends to providing a statement of account. I enclose £1 in payment of the statutory fee.

    2. A signed true copy of the deed of assignment of the above referenced agreement that you allege exists.

    3. You are notified that you are obliged to supply these documents, whether you are the original creditor or not under S189 of the CCA 1974.

    Non-compliance with my request is a criminal offence under the above Act and will result in a report being submitted to the relevant statutory authorities, therefore if I do not receive evidence that I owe your company any monies by 20 December 2007, I will have no hesitation in passing your details to the Office of Fair Trading.

    As you are aware, a credit agreement that is not properly documented and signed by the customer is totally unenforceable under the CCA and therefore is a complete defence to any court claim that is issued.

    Take note at this stage, that any legal action you may contemplate will be both vigorously defended and contested.

    You might also be pleased to hear that your income is actually £1672 pcm. Multiply your weekly income by 52 and divide by 12 to find monthly amount rather than multiplying weekly amounts by 4.

    See, I've saved you £600 per year already!

    i was never associated financially with any of my ex's anyway :)
    tv licence is for this yr and then they said when thats paid it will reduce to £11.31
    provident loan one loan of 500 add 325 @ 15 per week left to pay 330
    provident loan two loan of 300 add 204 @ 9 per week left to pay 205
    naylors loan 200 add 103 @12 per week left to pay 195
    yorkshire bank closed and went to citibank i think they are charges we are paying not sure anymore, will find out how much left to pay monday
    citibank closed this account as couldnt get any sense from call centre when we had any queries so gone to natwest, these are charges and 40 of 50 left to pay
    yourcalls.net was a telephone provider (cheap) but found cheaper and changed these are charges i believe will find out monday how much owing
    capquest is for the old catalogue i think littlewoods what is CCA letter please? this is finished 15th march
    catalogues my littlewoods around £100
    OH littlewoods i think £300
    my jdwilliams around £700
    OH jdwilliams around £250
    ERYC 1 payment left now 15th march
    swintons £60 charges i believe OH bought a moped from someone got insurance so he was legal to drive it, found out it was dodgy gave it back cancelled and these are the charges i believe £60 but £40 left to pay.

    and to be honest i dont know what happens to the rest although i know some of it is OH alcohol problem, but its not all i would love to try and save around £100 p/m and start again giving the kids their £3 pocket money a week each
