This takes the biscuit yet again with NR.The judge in OH ccj ruled that we should continue to pay the DMP amount.But NR wasen't happy and went back to court.OH filled in the form N245 and to get it put nearer to were we live.
Low and behold OH get court papers through for interim charging order before the ccj hearing.
I can't believe every thing is happening so quick, we haven't even been on a DMP a year,we must be the unlucky ones on a DMP were things aren't going right.

Believe me you are not the only one, initially trouble with Northern Rock, now Lloyds as they won't pick up the phone and speak to CCCS and CCCS will not do likewise, for some reason my payments haven't been going to Lloyds since Dec, CCCS tell me they have had payments returned, I am stuck in the middle trying to get them to talk to each other to sort it out but I'm banging my head against a brick wall....0

Who is you DMP with? I would suggest you give them a call and ask them to run through how to put a defence forward for a Charging Order. As this is an Interim Charging Order it has not been set as yet
Some ideas for a defence could be:
1. There are a number of debts and making a charging order in favour of one creditor would give that creditor an unfair priority over the other unsecured creditors.
2. If the debt is covered by the Consumer Credit Act you might apply for a Time Order and request that the court consider this before the charging order.
3. If the debt is very small in comparison to the amount of equity in the property then it could be argued that a charging order would be unfair.
As I don’t know your full situation it hard to give detailed advice as I mentioned please speak to you DMP company
