MBNA Help!

Ok so i got my self in Debt with 2 Credit Cards last year and started a DMP with a company that charged me . They never payed my creditors anything from Nov 07 Until Beginning of this month. Therefore i am in arreas with both Cards and have Been to Payplan about a new DMP.

So i cancelled all contact with my last DMP and sent my letters about my New DMP to my creditors to get back on track. I stated that i will be able to pay more money this way as payplan dont charge,

I got a call from MBNA Last night saying they have had no contact from me and they have not recived any letters from me ?????????????????

I have been paying token payments to both creditors and the call consultant tried bullying me into paying more which i didint cos i could not afford to.

I rang MBNA back today because last night the consultant explained i could set up a DMP direct with them but the guy on the phone today said i could not . Also he was very rude and arrogant to me regarding my situation and i ended up slamming the phone down,:mad: i am writing a letter of complaint to them and also again stressing my fanancial diffucultys and that i have tried several times to sort this out with them.

I mean im trying my hardest to pay them what i can and when you try to sort it they say no.

Is there anything they can do if i dont pay fullpayments cos im in arrears when ive been trying to sort out a DMP with them.

Also my Card with GEmoney i also sent my DMP letters to sent me a letter today stating i have 7 days to Pay £269 arreas or else they will request my total Balance off me which i cant afford!:eek:

    It has to be said that they are quite persistant and will continue to be so from the look of this thread, but there is some useful info regarding harrassment and trading standards.
    Blackadder: Am I jumping the gun, Baldrick, or are the words 'I have a cunning plan' marching with ill-deserved confidence in the direction of this conversation?

    Good move to the free DMP provider, this means the creditors are more likely to want to help as they are getting a better deal.
    Don’t worry about the people who call you as well as they are mostly on commission, so many will try and scare you into paying more than you can afford. But at the end of the day you can’t pay what you don’t have so even if they call once your DMP starts explain who you are with on the DMP and that a budget and details have been sent what you can afford and you can’t pay any more.

    Regard the arrears what they will be referring to send to you is a Default Notice requesting your outstanding arrears and full remaining balance because you have broken your original agreement. They have to do this before they normally look to pass this into a collections team/company. If they do this make your DMP provider aware of the change so they can send your payment to the correct people and stick to your guns and don’t give into them for extra payments. At this point in collections these people have the same power as your original creditor which means they can phone you, send letters but cannot send bailiffs, take your goods or even make anyone aware of your situation so don’t worry.

    Empathise with you as got into debt with MBNA and they have been utter ***** for the last year. Phone calls ++++ but they eventually stopped when i threatened them with harrassment. Had enough letters from them to fill up a sorting office...most of them are so (cleverly?) worded to mean very little but at the same time pressurise you. They will try every trick in the book and so i found the only way to deal was in writing and through the CAB.

    Since then they have sold the debt onto Link Financial (evidently MBNA use this company) who go straight for the jugular and charging orders etc. Following some advice on the consumer action group i sent a Consumer Credit Agreement request so that i could be sure that any supposed debt was in fact 'owned' by them. Thus far have had nothing back which is another thing. So beware if you come into contact with them!

    Despite that the Citizen's Advice bureau have been brilliant....when i eventually get out of debt they will certainly be getting donations from me!
