Need Urgent Advice Re Eviction Notice

Hi
Have not posted for a while, have been trying to deal with all my huge debt mountain.
Really need help, had a suspended possesion order granted agianst me November 2007 (last time of posting), had made arrangement for paying arrears on secured loan with lender which they wanted backed up with the order, happy to accept my offer of monthly installment, all payments maintained to date with proof of payments on bank statements.
Had hiccup in December when I called to make my payment over xmas hols, details of payment were taken by solicitiors dealing with this but not forwarded for collection of payment. My fault really, should have been more on the ball checking my bank statements and this was not spotted until beginning Jan when I received letter from court saying payment had been missed!! Callled the solictiors dealing with case who confirmed they had received payment details but no payment taken, payment was then made and all payments since have been made, but tonight have received warrant of repossesion thru my door dated 21 feb 2008!!!!:eek:
How can this happen when all payments have been maintained and the solictiors have admitted it was their error in not collecting Dec payment (this has been since collected and all payments maintained)
Need urgent advice on what to do next and am going to spend a sleepless night until court and solicitors open at 8.30 when I will be able to call them both to find out if I am going to be homeless.
Feel really scared and sick please advise.

Don't panic - you can (and should) get down to the County COurt and fill in the form for a stay of execution.
Also, ring Shelter. They are very helpful....much enquiry having been made concerning a gentleman, who had quitted a company where Johnson was, and no information being obtained; at last Johnson observed, that 'he did not care to speak ill of any man behind his back, but he believed the gentleman was an attorney'.0 -
Can the solicitors not submit a letter to or contact the court admitting they were at fault? I know it may be a long shot, but it may help?0

Update on yesterdays eviction notice
AAAARRRRGGGHHH !!!!!!!! Am completetly Stressed, have spent the best part of this morning on phone to solicitiors, court baliffs trying to get this stopped. Solicitors admit this is error and apparently sent letters to myself and court on 5th Feb both of which have not been received:mad:
I have confirmation although not in writing that this eviction will not take place, but am not confident as have rang cort balliff dealing with this (thought I would check solictors had done their job sendind fax to confirm cancelleation of evicition) and the balliff states that they have not received anything in writing via fax which is required to cancel the evicition and until they receive this from solicitor it still stands.
I have again contacted solicitors who assure me that this has been done!! but according to baliffs this hasnt.!!!!
Am really stressed and sick with worry, at the point where I am thinking I should go to court to sort it out myself before the evicition date.
Really dont know what else to do other than keep phoning and harrassing everyone concerned.
Any advice would be gratefully received.

As a precaution, check which number the solicitors have faxed, that they have a fax receipt. Then check the fax numbers at the bailiffs and ask the bailiff to check that their fax machine is working. We used to get loads of computer generated spam which would pour out, leaving the fax machine empty of paper and the messages stored in the machine until the paper was replaced.

Thanks, am on phone now getting some advice.
Have spoken to CCCS before to sort out my debt problems so am familiar with them (very nice people!!)
Am at the point of breakdown over this am so worried am going to lose my home over a mistake that was nothing to do with me.
Am trying so hard to be debt aware and make my payments on time and now this.

Have been on phone yet again to solicitors, have given them direct fax line to baliffs and am going to wait hour and ring court offices again in the hope that they have received fax.
Also been advised by cccs to ring mortgage co to confirm that all payments are in order and to get confirmation that they are not eviciting me to take to courts as proof.
Am so worried and feel completely at my wits end.0 -
