phoned acas yesterday and it seems his employer can do exactly what he wants as my son has been with the company less than a year!!-stinks
had no prevous warnings-only praise
my way of thinking is that he is perhaps better off if he does leave-its a massive company where it would seem everyone is merely a number on a production line
my son was aproached by a different company at the same time he was applying for his present post.he has contacted them and hopefully there may still be a chance of work with them so fingers crossed.
well-less than an hour to his meeting now-we'll see what happens!!
he's worried that if he gets dismissed it will look bad for prospective employers-just hope they give him the opportunity to resign!??-or should that not be a good ideaapril 2015-april2016...mark knofler tickets, sarah millican tickets, easter gift box0 -
ah well-my son has just called me-been dismissed with 2 months pay!!
he's worrying now that no-one will want to employ him!!
any advice please?april 2015-april2016...mark knofler tickets,sarah millican tickets, easter gift box0 -
did they actually say hes been dismissed and what for? or was it a case of them saying that youve been put off, we dont have the work etc etc, i cant see it as being an absolute dismissal as theyre paying 2 months on top, which in my view isnt so bad, surely hed get nowt if he was sacked for bad stuff?0

feared that might happen. A few posters have described what should happen - what's happened to your son is more like what does happen.
However the company have been generous in paying the two months - they didn't have to do that. This gives him a bit of time to find something else.
No doubt his confidence will have been dented by this, but he has to pick himself up. He can't look at it as being sacked - he didn't get through his probation and a more positive way to present that to future employers is that things just didn't work out and he and the employer decided to part company.
He is employable. Hopefully he might hear from the other company. If not he wants to sit down as soon as possible and work out a plan of action. Sounds as if he is in a niche market so with a bit of research - or he might know already - he can find out the other players. He should send off his CV, together with a targetted covering letter.
he could also get in touch with other graduates from his course and let them know he is on the look out. Most jobs are filled by word of mouth and they might know of vacancies.
Give him a big hug, let him lick his wounds, and then support him in his job search. good luck0 -
he's feeling relieved in a way-better to find out now what the companies like rather than later.
drawn a contingency plan and off job seeking tomorrow-hoping to hear from the other company who were originally interested too-
thanks to you all

Seems to me ACAS weren't necessarily giving you the full facts there.
Though under a year's employment means that there could not be a case of unfair dismissal (except in the case of discrimination on an unfair ground, like because of a disability - as has been mentioned earlier), a company CANNOT do "exactly what they want" if that is not in accordance with the employment contract. So you must ensure that the disciplinary process was followed according to the contract.
If dismissals are not carried out in accordance with the employment contract, that is wrongful dismissal, which is not the same as unfair dismissal.0
