bank transferred debt to debt collectors

Hi, my son is 19yrs old, unemployed at the moment and worried about a debt which started at HSBC.
He was travelling abroad last year and didn't realise that he was overdrawn by around £10. When he returned he found that the bank charges accumulated to £130. He went to see them about it but they said it was out of their hands and now with a debt collector. He has been mortified about this and doesn't know what to do. He offered to pay in stages (even though it's mainly bank charges!). It has been transferred to a solicitor and they want to take him to court or send in the bailiffs. He lives with me and doesn't have any money or assetts. I think he should contest the bank charges but the bank won't speak to him. Any help or advice would be appreciated.

He needs to start by making a SUbject Access request (SAR).

We also seriously need to find out exactly what has been siad in the letters, as I think he is being threatened with action that would be difficult to justify in court. He nneds to send the popel sending the threatening letters £1 per month as a payment towards the debt.

And if he is old enough to go travelling abroad, he also needs to get employment so that he can pay this off over time. It will take a while for the bank charges court case to come to fruition and he may not get it all back.

  • £130 and they've transferred it to debt collectors?

Has he got any access to £130 or even half of it? In my experience, when you get a letter off a debt collector there is sometimes a number for you to ring and discuss it.

Not being funny but it's going to cost the bank more to take him to court for £130. It'd go to a small claims court which handle anything up to *I think* £300..but they will have to pay for a solicitor, the judge's time and a court time slot!

Has he spoken to a solicitor?
;)I am not a complete idiot - some parts are missing;)
