  • Thanks everyone, i've so much to learn!! I'm going to ring and get some advice from an accountant tomorrow and see if I can get the ball rolling there. I have absolutely no correspondence from any other creditor so I haven't got the foggiest what to do now (is the answer really obvious, because if it is I can't see it) And all of the payments were stopped approx 3-3 1/2 year ago so I doubt the 6 year thing would apply (would it?)

    if the lag is 3.5 years, then the statute barred rule is unlikely to apply. We have however had people who re-started paying debts that were 15-20 years old that were statute barred because of the time lag between payments. They have now stopped paying.

    If it comes to it, come back for help with CCA letters, to make sure that the people that contact you re unsecured debt are entitled to collect the money they demand.

  • Hi, It has been ages since we've had any correspondence for the debt (except the IR and CT)

    I have got a break down of what I've filtered from the credit file.
    Judgments: (I said he had 2- this was a lie :D)
    1/3/04 £2762
    14/6/05 £1751
    22/12/05 259
    14/3/06 £3524

    Defaults:
    Barclays £7397 31/3/04
    Cabot financial £705 31/03/04
    CL finance £2823 21/1/04
    HFC £1003 20/07/02
    Hillesden securitues £7397

    How the hell do I go about making arrangements, should I be writing to the companies or leaving it until they get in touch with us?
    Will the Hillesden be the same debt as barclays?
    And how do i find out who the money for the ccjs is owed to? Could some of the ccj money also relate to the defaults?

    If anyone can help I would be so grateful, this isn't as easy as I was hoping and I obviously don't want to cause more problems by tackling it in the wrong way.

    Sorry but if there is a CCJs against an account the standard statute barred rules do not apply. Suggest he speak to one of the debt charities as they would much prefer to deal with him directly. There is a file that can be searched for CCJs somewhere and they will know how to access it.

    Any idea what they relate to? Ah no. The £259 CCJ does not even appear to be listed under the defaults.

    You might, might be able to get the CCJs set aside if his location was obvious to anyone in the financial world but they served it on an old address, but this is clutching at straws.

    I would not attempt to make arrangments at the moment, but to start saving up, so that he can make arrangments when they contact him.

    At least you know the damage now.

    I have one last question before my brain explodes. When we have saved up a reasonable sum and i'm looking at offering settlement, lets say 60% of the balance, can I offer this on the ccjs or now that they have been served do we have to pay the full amounts?

    With ref to your extra income and your OH hoped for extra income from the new job, I would suggest the right now you open an ISA or similar, and on pay day direct debit the extra money (or maybe less £50) straight into the new account. That way you still won't see the money, so no temptation, and the money is working for you in the mean time.

    The problem with these debts is that, if you write to one, it seems by osmosis to alert all of the other creditors too. I say this because if you did the above then in two months you could have offered CCJ 2 and Cabot Financial full and final settlements and that would be two debts gone.

    Ref contacting them, I seriously wouldn't do this yourselves. Debt Collections Agency staff are for the most part, complete and utter ****s, whose sole aim in life is to meet a target no matter how rude, threatening, unhelpful or cruel they have to be to do it. You need your OH (has to be him), to talk to either CCCS or Payplan for impartial (and more importantly) FREE advice. Their numbers are at the top of the forum.
