Debtors trying to secure the debt on my home

Sory if the thread is mis-leading, but wondered if someone might have had the same experience.My husband and I split up 2 years and left me with some debts, have gradually paid of some of the debts have only 2 left, one of which they have accept a monthly payment and I never miss payment. The other one is the one I want advice on and is an Egg loan (notorius Egg who claim to help you if in trouble) I told them I could not pay the full amount of the monthly amount after about a year and to cut a long story short, it ended up in the hands of their debt collectors, had alot of harrashment regularly from their operatives asking for money, I wrote to report them to Office of Trading who could not do alot. I offered them £100 a month the debt being £9600, sent them a budget sheet they knew I could not afford anymore, so they took it to court and I sent the court a letter with my budget and the court accepted but I got a CCJ against me the 1st of my life. I have been paying the £100 each month regularly but they have applied to courts to secure debt on my home, wrote to the court in Bradford and the courts have now arranged for it to be heard at my local court and want me to be present this week. As I sent a letter saying that I pay this debt each month without fail WHY should they want to put this on my home, which means I could never re-mortgage to even pay the debt off. So am going to court to try and stop this. Has this happened to anyone or does anyone know what my chances are of stopping this against my home. Thank you for reading this.

  • I think you are on the wrong board- i would suggest the Debt free wanabee board as it has lots of clued up people who can answer your problem. iwould also suggest a poster called Richard s on the bankruptcy board as he is extremely knowledegable.

    A charge on your house does not stop you remortgaging. If you wanted to remortgage you could arrange a deed of postponement, standard procedure.

    I do understand why you don't want the charge, especialy as its not your debt and you have been making repayments, but don't use an excuse that is not valid as the judge will know this.

    And just to avoid confusion, a debtor is someone who owes money. The people who worry you are your creditors.
