unusual 40p per mile question

Hope someone can help. I work away from home, and as part of my renumeration package I get my mileage paid whenever I go home. I get 25p per mile, and generally I get close to 10k miles per annum, but no more.

After 2 years this package became subject to tax and NI, but my employer pays that too. It's done through payroll, but I don't have a P11D.

So, given that my employer is paying the mileage and the tax, can I claim back the tax on the remainder of the 40p per mile?

I'm employed in the public sector, by the way. Don't know if that makes a difference.

    You say this is to enable you to go home. That is why your employer is now having to tax it. Home to work travel is not allowable for tax so you cannot claim any further deduction.

    The terms of my employment are that the costs of me being based away from home are met by my employers. I am also required to work from an office closer to home regularly. Am I unable to claim back the tax for the mileage incurred after 2 years (and it wasn't clear that it was continuing until 23 months in) to travel home and to be able to work in the other office?

    Also, I've been doing this 5 years - is there a time limit to how far back I can go?

    I take it that the mileage claimed purely for business purposes during the whole 5 years (under T&S) is covered, and that I can claim that?
