Calls at work from creditors

Hello all,

I've decided to go bankrupt in the next few weeks. I stopped paying my creditors in October after months of taking money out on one card to pay the rest, all the while the interest and charges stacking up. My debt is not massive, about £15,500, but then I've got a student loan of £18K aswell. I earn about £16.5K, live in London with no job prospects and a pretty sh*t life!

I know BR is the way only way forward for me.

I made one token payment back in December, after getting advice from the CCCS, but have stopped paying them now...I really don't see the point when I'm going BR anyway.

I'm so worried about the outcome of BR though - I was unemployed for a month and a half last march, and about 3 months in 2006, and lived off the CCs..When i found a new job I also put things like a suit and new work clothes on the cards, aswell as taking cash out when I had a much needed few days away. The OR is not going to look too favourably on this is he? :o

I keep getting phone calls from one of my creditors at work...can't remember how they got the number. Fortunately none of them have my mobile number, and I never answer the home phone.

I don't know what to do about this, as every time they call they want me to go through the same stuff again. It's like talking to a brick wall. I've told them I'm going BR, do they really think they can change my mind?!

Last week they were saying I should get a loan to consolidate my debts !!!!!!, as if anyone's going to give me a loan! (Not that I would do that anyway!)

What can I do, as it's hard for me to talk to them when my colleague is around, as I don't want him listening in on what I'm saying. :confused:

    you could always send each creditor a copy of this it usually does the trick!...they'll try every trick in the book to get cash from you even go as far as what they already suggested..PLEASE dont fall for the "consolidation loan" speech..once they know your contemplating BR. Have you saught any advice yet? loads of free helplines in my sig below...remember though if you do decide on BR as a solution student loans would still need to be paid as they dont fall under bankrputcy

    If you continue to call, you will also be in breach of the Wireless Telegraphy Act (1949) and, as such, I will report you to both Trading Standards and The Office of Fair Trading.

    Take further note that continued telephone calls after the receipt of a request not to call may constitute a criminal offence under Section 127 of the Communications Act 2003.

    You will be deemed to have been served notice of my request and I will deem it served by FULL DATE, I am advising you that any calls received after this date will be recorded with the intention of them being used as evidence.

    Yeah i know that feeling, a company call me everyday, sometimes twice and send letters normally a couple a week, Lucky they only have my mobile number and i never answer it, they have bought loads of my debt from the past, in the begining i was paying them £10 per month, but times get harder and i stopped and call afer call, letter after letter they still persue me.
    The debt is only for a mere £35000, should i wait till after my court date on the 15th Feb or just send them a cheque for the full £35000, with maybe a bit extra so they can have a drink on me?

    I shouldnt worry too much about these things, this is common to us all and the OR will be understanding about them - what else were you meant to do?
    If you read a few diary threads you will see so many of us have done the same thing.

    Phil's right about getting some independant advice, you will feel much better after that and with all the support you will receive here

  • Thanks for the advice everyone, just spoke to the creditor that has my work number, told them that all future correspondence must be in writing. (Going to send that letter tomorrow).

    He said they are allowed to call up to 3 times a day...admittedly they don't call me at work every day (YET) but i'm sure they must be calling my home phone or mobile (well, they would if they had my new mobile number :confused:) so basically I'm not sure if it qualifies as harrassment?

    I have taken advice from the CCCS, an IVA / DMP just wouldn't be feasible as theres literally very little left once I've paid for all my outgoings :o

    No useful advice to offer you, just wanted to wish you luck and tell you to stay positive and look to the future.. a year from now it will nearly all be over :beer:

    I must admit it is all a bit scary, just so worried, as I used the cards a lot in the last year or so, using one to pay the other, and withdrawing cash for bills and food etc...it's gonna look so bad! :confused:

    I would add the following to the suggested letter.

    Your telephone calls are in breach of the Office of Fair Trading guidelines. If you continue with them after the receipt of this letter an official complaint, together with a log recording the times and frequency of the calls will be passed both to that office and to the Trading Standards office.

    Furthermore, your telephone calls to my place of employment constitute harassment on your part; and also an attempt to put undue pressure on a debtor by attempting to embarrass them at their place of work.

    ANY further telephone calls to my place of employement will result in a formal complaint being raised with relevant authorities. This will be relevant to questions of your fitness to hold a licence under the Consumer Credit Act, whether or not it results in a prosecution.

  • hi u do relise student debts arnt included in br , as noone has mentioned that yet , before i went br my home phone rang up to 40 times a day now the thing has broken so no one can call .

    Do not worry about the phone calls they have no rights and cannot do anything.

    Simplest thing to do is when they ring just tell them to " have a day off " and put the phone down.

    Also send them the letter suggested by Phil and Fermi.
